The Secretary of State for Transport, at the request of the British Railways Board and in exercise of the powers conferred on him by section 3 of the British Railways (Penalty Fares) Act 1989(1), hereby makes the following Order:-
1.-(1) This Order may be cited as the British Railways (Penalty Fares) Act 1989 (Activating No. 1) Order 1990 and shall come into force on 29th October 1990.
(2) In this Order "the Act" means the British Railways (Penalty Fares) Act 1989.
2. Sections 4 to 9 of the Act shall have effect with respect to the train services provided by the Board specified in the Schedule to this Order, as from the 29th October 1990.

Article 2
1. All train services on the line between London, Fenchurch Streetand Shoeburyness stations, via Upminster, and from all stations on that line.
2. All train services on the line between London, Fenchurch Streetand Shoeburyness stations, via Tilbury, and from all stations on that line.
3. All train services on the line between Upminster and Tilbury Riverside stations, via Ockenden, and from all stations on that line.
(This note is not part of the Order)
This Order gives effect to the penalty fares provisions contained in sections 4 to 9 of the British Railways (Penalty Fares) Act 1989, with respect to the train services specified in the Schedule, as from the 29th October 1990.
