The Secretary of State, in exercise of the powers conferred upon him by section 38(4) of the Housing Act 1988(1) and of all other powers enabling him in that behalf, hereby makes the following Order-
1. This Order may be cited as the Commission for the New Towns (Specified Date) (Tenancies) Order 1990 and shall come into force on 23rd October 1990.
2. 31st March 1996 is the date specified for the purposes of section 38(4) of the Housing Act 1988.

Section 38 of the Housing Act 1988 governs the status of certain public sector residential tenancies transferred to the private sector. The tenancies concerned are those existing on the commencement of the Act or entered into pursuant to a contract made before the commencement. In the case of a disposal by the Commission for the New Towns in pursuance of a direction under section 37 of the New Towns Act 1981 (c. 64), "the commencement of the Act" is to be interpreted as 14th November 1990 or such other date as may be specified by Order, This Order specifies 31st March 1996 for the purposes of section 38(4).
