The Secretary of State, on application to him by the River Tay District Salmon Fishery Board, having carried out all necessary consultations and complied with all necessary procedures as required by paragraphs 3, 4 and 5 of Schedule 1 to the Salmon Act 1986(1) as applied by section 6(6) of that Act (there being no objections or representations duly made with respect to the proposals in the application), in exercise of the powers conferred on him by section 6(3) of that Act and of all other powers enabling him in that behalf, hereby makes the following Order:
1. This Order may be cited as the Annual Close Time (River Tay Salmon Fishery District) Order 1990 and shall come into force on 16th October 1990.
2. For the part of the River Tay salmon fishery district specified in the Schedule to this Order, the period within the annual close time (the dates of which are, by virtue of the provisions referred to in section 6(2)(b) of the Salmon Act 1986, 21st August to 4th February) when it is permitted to fish for and take salmon by rod and line is prescribed as the period from 21st August to 31st October, both dates inclusive.

Article 2
The part of the River Tay salmon fishery district mentioned in article 2 of this Order comprises the catchment area of the River Eden, all other waters flowing into St Andrews Bay and the adjacent area of sea bounded-
(a)on the north, by a line drawn due east from the eastern end of Abertay Sands and by a line drawn westwards from that eastern end along the ridge of the Sands to Tentsmuir Point; and
(b)on the south, by the southern boundary of the said district.
(This note is not part of the Order)
In relation to the annual close time of the River Tay salmon fishery district (21st August to 4th February) this Order prescribes the period from 21st August to 31st October as the period during which fishing for salmon and sea trout by rod and line is permitted in a specified part of the district. This part comprises the catchment area of the River Eden, all other waters flowing into St Andrews Bay and the adjacent area of sea between, in the north, a line drawn due east from the eastern end of Abertay Sands and westwards from there along the ridge of the Sands to Tentsmuir Point and, in the south, the southern boundary of the salmon fishery district. Within that specified part it will be permissible to fish for salmon and sea trout by rod and line during the period in each year from 5th February to 31st October. By virtue of section 1(1) of the Salmon Act 1986 the area of the salmon fishery district extends seaward for a distance of 3 miles from mean low water springs of the coastal limits of the district and landward to include the catchment area of each river flowing directly or indirectly into the sea within those coastal limits.
