The Secretary of State for Transport, in exercise of the powers conferred by sections 49, 51(1), 53(5) and 63(5) of the Road Traffic Act 1988(1) and the Department of Transport (Fees) Order 1988(2), and of all other enabling powers, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:-�
1. These Regulations may be cited as the Goods Vehicles (Plating and Testing) (Amendment) Regulations 1990 and shall come into force on 2nd April 1990.
2. The Goods Vehicles (Plating and Testing) Regulations 1988(3)rs) shall be further amended in accordance with the provisions of these Regulations.
3. In regulation 3(1)-�
(a)for
""the 1972 Act" means the Road Traffic Act 1972"(4) there shall be substituted
""the 1988 Act" means the Road Traffic Act 1988"(5); and
(b)in the definition of "vehicle testing station" for "section 45(9) of the 1972 Act" there shall be substituted "section 52(2) of the 1988 Act".
4. In regulation 8-�
(a)in paragraph (1)-�
(i)in sub-paragraph (a) for "section 45(3) or (4) of the 1972 Act" there shall be substituted "section 50(2) or (4) of the 1988 Act";
(ii)in sub-paragraph (b) for "section 45(3) of the 1972 Act" there shall be substituted "section 50(2) of the 1988 Act"; and
(iii)in sub-paragraph (c) for "section 45(4) of the 1972 Act" there shall be substituted "section 50(4) of the 1988 Act"; and
(b)in paragraph (2)(h) for "section 45(8) of the 1972 Act" there shall be substituted "section 52(1) of the 1988 Act".
5. In regulation 18(2) for "section 48(5) of the 1972 Act" there shall be substituted "section 59(4) of the 1988 Act".
6. In regulation 40(1) for "section 45(3) or (4) of the 1972 Act" there shall be substituted "section 50(1) or (3) of the 1988 Act".
7. In regulation 41(1) for "section 48(5) of the 1972 Act" there shall be substituted "section 59(4) of the 1988 Act".
8. For the cross heading to regulation 44 there shall be substituted "Exemptions from section 53(1) and (2) of the 1988 Act".
9. In regulation 44-�
(a)in regulation (1)-�
(i)for "section 46(1) and (2) of the 1972 Act" there shall be substituted "section 53(1) and (2) of the 1988 Act";
(ii)in sub-paragraph (e) for "section 42 of the 1972 Act" there shall be substituted "section 44 of the 1988 Act" and
(iii)in sub-paragraph (f) for "a police constable" there shall be substituted "a constable"; and
(b)in paragraph (2) for "section 46(1) and (2) of the 1972 Act" there shall be substituted "section 53(1) and (2) of the 1988 Act".
10. For the cross heading to regulation 45 there shall be substituted "Exemption from section 63(2) of the 1988 Act".
11. In regulation 45 for "section 51(2) of the 1972 Act" there shall be substituted "section 63(2) of the 1988 Act".
12. In regulation 46-�
(a)in paragraph (1) for "section 46(1) or (2) of the 1972 Act" there shall be substituted "section 53(1) or (2) of the 1988 Act"; and
(b)in paragraph (2)(d) for "section 46(1) or (2) of the 1972 Act" there shall be substituted "section 53(1) or (2) of the 1988 Act".
13. In the regulations specified in column 1 of the Table for the amounts specified in column 2 of the Table there shall be substituted the amounts specified in column 3 of the Table.

14. In Schedule 2 in paragraph 35 for "section 42(1) of the 1972 Act" there shall be substituted "section 44(1) of the 1988 Acr".
15. In Schedule 3 in paragraph 3 for "(as defined in section 82 of the 1972 Act)" there shall be substituted "(as defined in section 85 of the 1988 Act)".

These Regulations amend the Goods Vehicle (Plating and Testing Regulations 1988 (the "1988 Regulations") as follows.
1. Regulation 13 makes the following amendments to the fees prescribed by the 1988 Regulations.
(a)The fee payable on an application for a first examination or periodical test is increased from £26.50 to £28.00 in the case of a motor vehicle and from £14.50 to £15.25 in the case of a trailer.
(b)The fee for a re-test or further re-test within 14 days after the first examination or earlier re-test at the same station or at another station and by arrangement is increased from £13.50 to £14.25 in the case of a motor vehicle and from £7.75 to £8.25 in the case of a trailer. The fee for re-tests in other circumstances is increased from £26.50 to £28.00 in the case of a motor vehicle and from £14.50 to £15.25 in the case of a trailer.
(c)The fee payable on a request for an amendment to a plating certificate following a notifiable alteration or for a re-test where a particular in the certificate is or may be no longer applicable is increased from £11.00 to £11.75.
(d)The fee payable on an application for a replacement for a lost or defaced plate, certificate or ministry test date disc is increased from £7.75 to £8.25.
The Regulations do not affect the supplement to the fees payable for examinations or tests on Saturdays.
2. The Regulations substitute the word "constable" for a reference to "police constable".
3. The opportunity has been taken to update references to the Road Traffic Act 1972 to refer to the Road Traffic Act 1988.
S.I. 1988/643 which was made under s. 102 of the Finance (No. 2) Act 1987 (c. 51). The relevant reference in S.I. 1988/643 is item 2 of Table II of Schedule 1.
1972 c. 20 which was repealed by section 3(1) and Part I of Schedule 1 to the Road Traffic (Consequential Provisions) Act 1988 (c. 54).
