The Lord Chancellor, in exercise of the powers conferred on him by section 38(7) of the Administration of Justice Act 1982(1) and with the concurrence of the Treasury, hereby makes the following Rules.
1. These Rules may be cited as the Court Funds (Amendment) Rules 1990 and shall come into force on 1st April 1990.
2. Rule 20 of the Court Funds Rules 1987(2) shall be revoked.
Mackay of Clashfern, C.
Dated 5th March 1990
We concur,
John Taylor
Stephen Dorrell
Two of the Lords Commissioners of Her Majesty's Treasury
Dated 6th March 1990
(This note is not part of the Rules)
These Rules revoke rule 20 of the Court Funds Rules 1987 which required payments under county court judgments and orders to be paid into court. Following the restriction of the banking function of county courts by the County Court (Amendment No. 3) Rules 1989 (S.I. 1989/1838), most payments under judgments and orders pass directly between the parties.
S.I. 1987/821, to which there are amendments not relevant to these Rules.
