The Secretary of State, in exercise of the powers conferred on him by section 7(2) and (3) of the Transport (Scotland) Act 1989(1), and of all other powers enabling him in that behalf, hereby makes the following Order:
1. This Order may be cited as the Transport (Scotland) Act 1989 (Transfer of Shipping Companies) Appointed Day Order 1990 and shall come into force on 2nd April 1990.
2. 2nd April 1990 shall be the day appointed for the purposes of section 7 of the Transport (Scotland) Act 1989.
3.-(1) The enactments specified in the first column of Schedule 1 to this Order are hereby amended to the extent set out in the second column of that Schedule.
(2) For any reference in the enactments specified in Schedule 2 to this Order to the Scottish Transport Group, there shall be substituted a reference to Caledonian MacBrayne Limited.

Section 56(15) of the Transport Act 1962(2) | in place of the words "the Scottish Group and their subsidiaries" there shall be substituted the words "Caledonian MacBrayne Limited" |
Section 55(2) of the Transport Act 1968(3) | (1) in place of the words "the Scottish Group and any subsidiary of that Group, but shall not include road passenger transport services, or services or facilities provided by virtue of section 50(3) of this Act" there shall be substituted the words "Caledonian MacBrayne Limited"; |
(2) in place of the words "the Scottish Group and their subsidiaries" and "the Scottish Group" where they occur in paragraphs (a) and (c) respectively there shall be substituted the words "Caledonian MacBrayne Limited". |

1. The Scottish Transport Group (Oban Quay) Order 1974(4).
2. The Scottish Transport Group (Port Ellen Harbour) Order 1975(5).
3. The Lochmaddy and East Loch Tarbert (Improvement of Piers & c.) Order 1984(6).
4. The Scottish Transport Group (Oban Quay) Harbour Revision Order 1986(7).
5. The Scottish Transport Group (Scalasaig Pier) Harbour Revision Order 1987(8).
6. The Scottish Transport Group (Castle Bay Pier) Empowerment Order 1988(9).
(This note is not part of the Order)
This Order appoints 2nd April 1990 as the day on which, by virtue of section 7(2) of the Transport (Scotland) Act 1989, ownership of Caledonian MacBrayne Limited and David MacBrayne Limited is transferred from the Scottish Transport Group to the Secretary of State.
The Order also substitutes references to Caledonian MacBrayne Limited for certain statutory references to the Scottish Transport Group; the principal effect of the substitutions is to preserve the existing role of the Scottish Transport Users Consultative Committee in relation to Caledonian MacBrayne Limited.
