The Local Elections (Declaration of Acceptance of Office) (Welsh Forms) Order 1991

The Secretary of State for Wales, in exercise of the powers conferred on him by sections 83(1) and (4) of the Local Government Act 1972(1), section 31(7) of the Local Government and Housing Act 1989(2), section 2(2) and (3) of the Welsh Language Act 1967(3) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Local Elections (Declaration of Acceptance of Office) (Welsh Forms) Order 1991 and shall come into force on 10th June 1991.

Forms of delaration of acceptance of office

2. The declaration of acceptance of office by the chairman, vice-chairman or a councillor of the council of a county or district in Walers may be in the form in Schedule I to this Order, or a form to the like effect, in place of the declaration of acceptance of office set out in the Schedule to the Local Elections (Principal Areas) (Declaration of Acceptance of Office) Order 1990(4).

3. The declaration of acceptance of office by the chairman or a councillor of a community council may be in the form in Schedule II to this Order, or a form to the like effect, in place of the declaration of acceptance of office set out in the Local Elections (Parishes and Communities) (Declaration of Acceptance of Office) Order 1990(5).

Revocation of Previous Forms of Declaration of Acceptance of Office

4. Article 3 of and Part II of the Schedule to the Local Elections (Principal Areas) (Welsh Forms) Order 1987(6) (form of declaration of office by chairman, vice-chairman or councillors of a county or district in Wales) is hereby revoked.

5. Article 3 of and Part II of the Schedule to the Local Elections (Communities) (Welsh Forms) Order 1987(7) (form of delaration of office by chairman, vice-chairman or councillors of a community council) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order prescribes the form of declaration of acceptance of office which may be made in welsh by the chairman, vice-chairman or a councillor of the council of a county, district, or a community in Wales in place of the prescribed English forms of delaration of acceptance of office. The person making the declaration is required to undertake to be guided by the National Code of Local Government Conduct issued under section 31(1) of the Local Government and Housing Act 1989. (The Code was issued as DOE Circular 8/90, Welsh Office Circular 23/90, and is available from HMSO (ISBN 0 11 752289 9).) A Welsh language translation of the Code is also available from the Welsh Office.

The order revokes the previous forms of declaration of acceptance ofoffice which would be made in Welsh and which are now superseded by the provisions of this Order.
