Coming into force in accordance with article 1
The Secretary of State, in exercise of the powers conferred on him by sections 1(1) and (2) and 24(1) of the Food and Environment Protection Act 1985(1), and of all other powers enabling him in that behalf, hereby makes the following Order:
1. This Order may be cited as the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No.2) Order 1991 Revocation Order 1991 and shall come into force at 1800 hours on 9th August 1991.
2. The Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No.2) Order 1991(2) is hereby revoked to the extent that it is still in force(3).

This Order revokes, so far as it is still in force, the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No.2) Order 1991 ("the No.2 Order") which imposed prohibitions on the fishing for or taking of (article 4), the movement of (article 5) and the landing of or use in the production of food (article 6) of bivalve molluscs within the area designated in the Schedule to that Order. The Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No.2 Partial Revocation) and (Nos. 4 and 5 Revocation) Order 1991 revoked the application of the No.2 Order to the designated area apart from an area within Loch Toscaig. This Order removes completely the prohibition on fishing for, or taking, landing, or the use in food production of bivalve molluscs from Loch Toscaig.
1985 c. 48; sections 1(1) and (2) were amended respectively by section 51(2)(a) and (b) of the Food Safety Act 1990 (c. 16), and section 24(1) was amended by paragraph 29 of Schedule 3 to that Act; section 1(2) defines "designating authority" and section 24(1) defines "the Ministers".
