The Education (National Curriculum) (Attainment Targets and Programmes of Study in Geography) (Wales) (Amendment) Order 1991

Whereas the Secretary of State has give n notice of the proposal to make this Order to the Curriculum Council for Wales and to all other persons with whom consultation appeared to him desirable, in accordance with section 21(2) of the Education Reform Act 1988(1):

And wheras the Secretary of State, in accordance with subsection (3) of the said section 21, duly published a draft of this Order and the other documents mentioned in that subsection and sent copies of them to the said Council and to each of the persons consulted by him, and allowed a period of not less than one month for the submission of evidence and representations;

And wheras that period has now expired;

Now therefore in exercise of the powers conferred on him by sections 4(2)(a) and (b) and (4) and 232(5) and (6) of the Education Reform Act 1988 the Secretary of State for Wales hereby makes the following Order which, subject to certain modifications, is in terms of the said draft:-

Citation, commencement, application and interpretation

1.-(1) This Order may be cited as the Education (National Curriculum) (Attainment Targets and Programmes of Study in Geography) (Wales) (Amendment) Order 1991 and shall come into force on 11th December 1991.

(2) In this Order "the principal Order" means the Education (National Curriculum) (Attainment Targets and Programmes of Study in Geography) (Wales) Order 1991(2).

2. Article 1 of the Principal Order is amended as follows:-

(a)in paragraph (2) before the definition of "the Document" there shall be inserted the following definition:-

3. Article 6 of the principal Order shall be amended by adding after the words "programmes of study" the word "either" and by adding after the words "in the Document" the words "or in the Annex to the Document".

4. For article 7 of the principal Order there shall be substituted the following article:-

"7.-(1) Schedule 1 has effect in accordance with this article for specifying the attainment targets (including the range of levels of attainment) for each key stage, the levels applicable being those appropriate to the different abilities and maturities of the pupils being taught.

(2) Subject to paragraph (3) the attainment targets described in the Document and set out in column 2 of Schedule 1 to this Order are specified in relation to the key stages set out beside them in column 1 of that Schedule.

(3) According to the programme of study followed by the pupil, the attainment targets specified for a pupil in the fourth key stage are either those set out in column 2 of Schedule 1 to this Order in relation to that key stage by reference to the Document or those so set out by reference to the Annex to the Document."

5. Article 8 of the principal Order is hereby amended as follows:-

(a)at the beginning of paragraph (2) there shall be added the words "Subject to paragraph (3)"; and

(b)at the end of the article there shall be added the following paragraph:-

"(3) The programme of study specified for a pupil in the fourth key stage is at the option of the school, either that set out in column 2 of Schedule 2 to this Order in relation to that key stage by reference to the Document or that so set out by reference to the Annex to the Document."

6. Article 9 of the principal Order shall be amended by adding after the words "printed in italics" the word "either" and by adding after the words "in the Document" the words "or in the Annex to the Document".

7. Schedule 1 (Specification of Attainment Targets) to the principal Order shall be amended by substituting for the provisions in Column 2 set out beside the fourth key stage in Column 1 the following provisions:-

Explanatory Note

(This note is not part of the Order)

This Order amends the Education (National Curriculum) (Attainment Targets and Programmes of Study in Geography) (Wales) Order 1991 (S.I. 1991/751) ("the principal Order"). The modifications in this Order to the draft Order published in pursuance to the requirements of section 21(3) of the Education Reform Act 1988 are limited to ones of a drafting nature.

Section 4(4) of the 1988 Act allows an Order, instead of containing the provisons to be made, to refer to provisions in a Document published by Her Majesty's Stationery Office.

The principal Order refers to such a Document. It is entitled "Geography in the National Curriculum (Wales)" That Document sets out the attainment targets and programmes of study which are to have effect for each of the key stages of a pupil's compulsory schooling in relation to geography.

This amending Order makes provison at key stage 4 for alternative attainment targets and a programme of study in a short course in Geography by reference to an Annex to the Document, entitled "Short Course at Key Stage 4, Annex to Geography in the National Curriculum (Wales)" ("the Annex"). Articles 5 and 7 make amendments relating to the alternative attainment targets and articles 6 and 8 make amendments relating to the alternative programmes of study.

The amendment made by article 3 secures that the attainment targets and programme of study set out in the Annex to the Document form part of the principal Order.

The amendment made by article 6 secures that any examples printed in italics in the Annex are illustrative only, and do not form part of the principal Order.

In pursuance of the amendments, a maintained school in Wales may provide pupils in the fourth key stage with either the programme of study set out in the Document or that set out in the Annex. The former covers a widr range of study than the latter. Which programme of study a pupil follows is determined by his school.
