The Gaming Act (Variation of Fees) (Scotland) Order 1991

The Secretary of State, in exercise of the powers conferred on him by sections 48(5) and 51(4) of the Gaming Act 1968(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

1. This Order may be cited as the Gaming Act (Variation of Fees) (Scotland) Order 1991, shall extend to Scotland only and shall come into force on 1st April 1991.

2. The provisions of section 48 of the Gaming Act 1968 specified in column 1 of the Schedule to this Order (which relate to fees charged in respect of the matters mentioned in column 2 of that Schedule) shall have effect as if, for the references to the sums specified in those provisions (for which the sums mentioned in column 3 of that Schedule were substituted by the Gaming Act (Variation of Fees) (Scotland) Order 1990(2), there were substituted references to the sums specified in column 4 of that Schedule.

3. In the Schedule to the Gaming Act (Variation of Fees) (Scotland) Order 1990 there shall be omitted the entries relating to the following provisions of section 48 of the Gaming Act 1968, namely paragraphs (a), (b), (f) and (g) of subsection (3) and paragraphs (a) and, except in relation to transfer of a licence, (b) of subsection (4).

Explanatory Note

(This note is not part of the Order)

This Order alters the fees to be charged in Scotland under the Gaming Act 1968 for the matters mentioned in the Schedule to the Order. The fees for the grant or renewal of a gaming licence, including the case where gaming is limited to bingo, are reduced. The other fees mentioned in the Schedule are increased. The Order comes into force on the same date as the Gaming (Amendment) Act 1990 (Commencement) Order 1991 (S.I. 1991/59) brings into force amendments of the Gaming Act 1968 which provide for the charging of new fees in respect of applications for certificates consenting to the making of applications for the grant of licences under the 1968 Act and for the transfer of such licences.
