The Secretary of State for Transport, at the request of the British Railways Board and in exercise of the powers conferred on him by section 3 of the British Railways (Penalty Fares) Act 1989(1) and of all other enabling powers, hereby makes the following Order:-�
1. -�
(1) This Order may be cited as the British Railways (Penalty Fares) Act 1989 (Activating No. 2) Order 1991 and shall come into force on 20th January 1992.
(2) In this Order "the Act" means the British Railways (Penalty Fares) Act 1989.
2. -�
(1) Subject to paragraph (2) below, sections 4 to 9 of the Act shall have effect with respect to the train services provided by the Board specified in the Schedule to this Order, as from 20th January 1992.
(2) Sections 4 to 9 of the Act shall not have effect with respect to any part of a train service, other than a conductor train service, specified in the Schedule to this Order which commences at a station where, at the time of commencement of the part in question of the service, there was no ticket office open for the sale of fare tickets or any facility for the sale of deferred fare authorities.

1. Between London Bridgeand Crystal Palace, via Sydenham.
2. Between London Bridgeand Purley, via Sydenham.
3. Between London Victoria and East Croydon, via Norbury.
4. Between South Croydon and East Grinstead.
5. Between Purleyand Caterham.
6. Between Hurst Greenand Uckfield.
7. Between London Bridge and London Victoria, via Denmark Hill.
8. Between Purley and Tattenham Corner.
9. Between Balham and Beckenham Junction, via Crystal Palace.
10. Between Balham and Sutton, via Hackbridge.
11. Between Wimbledon and West Croydon, via Mitcham.
12. Between Wimbledon and Norwood Junction, via Sutton.
13. Between Wimbledon and Selhurst, via Sutton.
14. Between Tulse Hill and Norwood Junction.
15. Between Peckham Rye and Streatham Hill, via Tulse Hill.
16. Between Peckham Rye and Streatham Common, via Tulse Hill.
17. Between Peckham Rye and Mitcham Junction, via Tulse Hill.
18. Between Peckham Rye and Wimbledon, via Tulse Hill.
19. Between Sutton and Bookham.
20. Between Leatherhead and Dorking.
21. Between Sutton and Epsom Downs.
(This note is not part of the Order)
This Order gives effect to the penalty fares provisions contained in sections 4 to 9 of the British Railways (Penalty Fares) Act 1989, with respect to the train services specified in the Schedule, as from 20th January 1992.
