The Secretary of State for Health, in exercise of powers conferred by sections 12 and 126(4) of, and paragraphs 10(2), 12 and 16 of Schedule 5 to, the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, and after consultation, in accordance with paragraph 11(1) of that Schedule, with bodies recognised by him as representing persons who, in his opinion, are likely to be affected by the regulations, hereby makes the following Regulations:-

Citation, commencement and interpretation

1.-(1) These Regulations may be cited as the National Health Service Training Authority and Disablement Services Authority Regulations 1991 and shall come into force on 1st April 1991.

(2) In these Regulations:

"the old Authority" means the National Health Service Training Authority;

"the new Authority" means South Western Regional Health Authority(2).

Transfer of officers

2. Any officer employed by the Old Authority immediately before 1st April 1991 shall on that date be transferred to the employment of the new Authority and the contract of employment between such officer and the old Authority shall be modified so as to substitute the new Authority as the employer.

Revocation of National Health Service Training Authority Regulations

3. The National Health Service Training Authority Regulations 1983(3), the National Health Service Training Authority Amendment Regulations 1986(4) and paragraph 5 of Schedule 3 to the Regional and District Health Authorities (Membership and Procedure) Regulations 1990(5) are hereby revoked.

Revocation of Disablement Services Authority Regulations

4. The Disablement Services Authority Regulations 1987(6) and paragraph 8 of Schedule 3 to the Regional and District Health Authorities (Membership and Procedure) Regulations 1990 are hereby revoked.

Explanatory Note

(This note is not part of the Regulations)

The National Health Service Training Authority (Abolition) Order 1991 (S.I. 1991/327) abolishes the National Health Service Training Authority, a special health authority established under the National Health Service Act 1977. These Regulations provide for the transfer of staff from that authority, on its abolition, to the South Western Regional Health Authority (article 2). They also revoke the Regulations which provided for the membership and procedure of and the appointment of officers to that authority (article 3).

In addition, following the winding up of the Disablement Services Authority as provided for in the Disablement Services Authority (Establishment and Constitution) Order 1987 (S.I. 1987/808), the opportunity has been taken in article 4 of these Regulations to revoke the Regulations which provided for the membership and proceedings of that authority.
