In exercise of the powers conferred by section 86(7) and (15) of the Environmental Protection Act 1990(1), the Secretary of State for Education and Science, as respects England, the Secretary of State for Scotland, as respects Scotland, and the Secretary of State for Wales, as respects Wales, hereby make the following order:
1.-(1) This Order may be cited as the Litter (Designated Educational Institutions) Order 1991 and shall come into force on 1st April 1991.
(2) In this Order "the Act" means the Environmental Protection Act 1990.
2. The Secretary of State hereby designates for the purposes of Part IV of the Act the Open University and each of the descriptions of educational institution mentioned in section 98(2) and (3) of the Act, with the exception in relation to Scotland of schools referred to in paragraph (g) of section 98(3) (grant-aided schools) which are grant-aided special schools to which the Special Schools (Scotland) Grant Regulations 1990(2) apply.

Under section 86(7) of the Environmental Protection Act 1990 ("the Act") the Secretary of State may by order designate any educational institution or descriptions of educational institution, for the purposes of Part IV of the Act. This Order designates for the purposes of Part IV of the Act the Open University and the descriptions of educational institution set out in sections 98(2) and (3) of the Act, with the exception in relation to Scotland of grant-aided special schools to which the Special Schools (Scotland) Grant Regulations 1990 apply. The types of educational institution set out in sections 98(2) and (3) are those wholly or mainly dependent on public funds for their support.
