The Secretary of State for Education and Science, in exercise of the powers conferred by sections 3(b) and (c) and 4(2) and (3) of the Education Act 1962(1) ("the Act") hereby makes the following regulations:-�
1.-(1) These Regulations may be cited as the State Awards (Amendment) Regulations 1991 and shall come into force on 17th April 1991.
(2) Save in so far as these regulations are made in pursuance of section 3(b) of the Act (awards in respect of post graduate and comparable courses) they shall not extend to Wales so as to apply in respect of persons ordinarily resident therein.
2. In paragraph 1 of Schedule 2 to the State Awards Regulations 1978(2) the definition of "relevant territory" shall be amended by the substitution for the words "and (as regards any period prior to their accession to that Community) the Kingdom of Spain and the Portuguese Republic" the words "and (as respects any period prior to the unification of the Federal Republic of Germany) the former German Democratic Republic."

These regulations amend the State Awards Regulations 1978 so that for the purpose of determining eligibility for an award residence in the former German Democratic Republic prior to the unification of the Federal Republic of Germany is treated as residence in the European Community.
1962 c. 12: the relevant provisions, as amended, are set out in Schedule 5 to the Education Act 1980 (c. 20); section 3 was further amended by Schedule 6 to the Education (No. 2) Act 1986 (c. 61).
