CONTAMINATION OF FOOD

The Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No. 14 Revocation) Order 1992

Coming into force in accordance with article 1

The Secretary of State, in exercise of the powers conferred on hin by sections 1(1) and (2) and 24(1) of the Food and Environment Protection Act 1985(1) and of all other powers enabling him in that behalf, hereby makes the following Order.

Citation and commencement

1. This order may be cited as the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No. 14 Revocation) Order 1992 and shall come into force at 17.00 hours on 23rd January 1992.

Revocation

2. The Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No. 14) Order 1991(2) is hereby revoked.

Explanatory Note

(This not is not part of the Order)

This Order revokes the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No. 14) Order 1991 which prohibited-

(a)fishing for or taking scallops and queen scallops within the area designated in the Schedule to that Order (article 4).

(b)movement of scallops and queen scallops out of that area (article 5).

(c)landing, using in the preparation or processing for supply of food or, supplying and other specified activities in relation to, scallops and queen scallops from the designated area within the United Kingdom (article 6).

The effect of the order is to remove completely the prohibition in fishing for, or taking of, landing of or the use in food production of scallops and queen scallops from the sea to the north of the mainland of Orkney between Mull Head and Brough Head and surroundinbg all the North Isles of the Orkney Islands.

1985 c. 48, section 1(1) and (2) was amended respectively by section 51(2)(a) and (b) of the Food Safety Act 1990 (c. 16), and section 24(1) was amended by paragraph 29 of Schedule 3 to that Act; section 1(2) defines "designating authority" and section 24(1) defines "the Minister".
