The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by section 84(1) of the Animal Health Act 1981(1), and of all other powers enabling them in that behalf, with the approval of the Treasury in accordance with the said section 84(1), hereby make the following Order:
1. This Order may be cited as the Poultry Flocks, Hatcheries and Processed Animal Protein (Fees) Order 1992 and shall come into force on 15th July 1992.
2.-(1) There shall be paid in respect of each transaction described in column (1) of the Schedule the fee specified in column (2) of the Schedule.
(2) In the case of the transactions in items 1 and 2 of the Schedule the fee shall be paid to the appropriate Minister.
(3) In the case of other transactions in the Schedule the fee shall be paid to the Minister.
(4) In the case of a transaction numbered 1, 2(a), 2(b), 2(d) or 5 in the Schedule the fee shall be paid by the applicant when making the application for registration or authorisation.
(5) In the case of any other transaction in the Schedule the fee shall be paid by the person in whose name the premises are registered under the appropriate Order, such fee being payable within 14 days of demand being made by the appropriate Minister or the Minister as the case may be.
(6) Any reference in this article to a Schedule is a reference to the Schedule to this Order.
3. The Poultry Flocks, Hatcheries and Processed Animal Protein (Fees) Order 1990(2) and the Poultry Flocks, Hatcheries and Processed Animal Protein (Fees) (Amendment) Order 1991(3) are hereby revoked.

3. The figures in column (3) are the fees which were charged under the Poultry Flocks, Hatcheries and Processed Animal Protein (Fees) Order 1990 as amended (S.I. 1990/530 amended by S.I. 1991/405) before the coming into force of this Order.
(This note is not part of the Order)
This Order replaces the Poultry Flocks, Hatcheries and Processed Animal Protein (Fees) Order 1990 as amended. It provides for fees to recover the full cost of the transactions specified in the Order in respect of laying and breeding flock and hatchery premises and for the purpose of authorising laboratories under certain orders relating to poultry and protein processing. In the cases of new applications and applications for renewal of registration or authorisation the fees become payable at the time the application is made. Otherwise the fee is payable on demand.
