The Housing (Right to Buy) (Prescribed Forms) (Amendment) Regulations 1992

Coming into force

17th August 1992

The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by section 176(1) and (5) of the Housing Act 1985(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Housing (Right to Buy) (Prescribed Forms) (Amendment) Regulations 1992 and shall come into force on 17th August 1992.

Amendment

2. For the list of public sector landlords at the end of the form set out in Schedule 1 to the Housing (Right to Buy) (Prescribed Forms) Regulations 1986(2) there is substituted the list set out in the Schedule to these Regulations.

Saving

3. Nothing in these Regulations shall affect the validity of any notice served under section 122(1) of the Housing Act 1985 before 17th October 1992 if the notice was in the form prescribed by the Regulations mentioned in regulation 2 above.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the prescribed form of notice to be used by a tenant in claiming to exercise the right to buy under Part V of the Housing Act 1985. The form lists certain bodies which are public sector landlords. Periods spent as a tenant of such a body are relevant in relation to qualification for the right to buy and entitlement to discount.

The amendments to the form reflect the Housing (Right to Buy) (Prescribed Persons) Order 1992 (S.I. 1992/1703), which amends the list of bodies to be treated as public sector landlords under Part V of the 1985 Act.
