The Secretary of State for Transport, in exercise of the powers conferred by sections 89(3) and (4)(b), 97(3A)(e), 105(1), (3) and (4), 108(1)(1) and 192(1)(2) of the Road Traffic Act 1988(3) and of all other enabling powers, and after consultation with representative organisations in accordance with section 195(2) of that Act, and in the case of regulations 3 and 4 with the approval of the Treasury, hereby makes the following Regulations:
1. These Regulations may be cited as the Motor Vehicles (Driving Licences) (Amendment) (No. 3) Regulations 1992 and shall come into force for all purposes other than those of regulation 4 on 14th August 1992 and for the purposes of regulation 4 on 1st January 1993.
2. The Motor Vehicles (Driving Licences) Regulations 1987(4) shall be amended in accordance with the following provisions of these Regulations.
3. In regulation 19 (Fees in respect of tests)-
(a)in paragraph (3)(a)(i)-
(i)for "£26 " there shall be substituted "£28.50 ", and
(ii)for "3rd June 1991 " there shall be substituted "14th August 1992 ";
(b)in paragraph (3)(a)(ii) for "£28.50 " there shall be substituted "£34 ";
(c)in paragraph (3)(b)(i)-
(i)for "£19.50 " there shall be substituted "£21.50 ", and
(ii)for "3rd June 1991 " there shall be substituted "14th August 1992 ";
(d)in paragraph (3)(b)(ii) for "£21.50 " there shall be substituted "£23.50 ";
(e)in paragraph (5) for "£21.50 " there shall be substituted "£23.50 ".
4. In regulation 19 as amended by the foregoing regulation-
(a)in paragraph (3)(a) for sub-paragraphs (i) and (ii) there shall be substituted the following sub-paragraphs-
"(i)£34 if the test is to commence before half past four in the afternoon, and
(ii)£44 if the test is to commence at or after that time,";
(b)in paragraph (3)(b) for sub-paragraphs (i) and (ii) there shall be substituted the following sub-paragraphs-
"(i)£23.50 if the test is to commence before half past four in the afternoon, and
(ii)£35 if the test is to commence at or after that time,".
5. In paragraph (5) of regulation 23B (Nature and approval of training courses) for "£2.10 " there shall be substituted "£5.00 ".

These Regulations amend regulations 19 and 23B of the Motor Vehicles (Driving Licences) Regulations 1987.
From 14th August 1992 the fee for an ordinary driving test taken on a day other than a Saturday will be - (a) £34 in the case of a test of competence to drive a motorcycle or a moped (an increase of £5.50), and (b) £23.50 in the case of any other test (an increase of £2): see regulation 3(a) to (d).
There is no increase in the fee for an ordinary test taken on a Saturday or for a court ordered extended test whenever taken.
With effect from 14th August 1992 the fee for a test in respect of the holder of or an applicant for a licence to drive a London cab will be increased from £21.50 to £23.50: see regulation 3(e).
From 1st January 1993 the Secretary of State, through the Driving Standards Agency, will be introducing a nationwide evening testing scheme. This service will be available in respect of ordinary driving tests taken in the week. The charge for such a test scheduled to start on or after 4.30pm will be the same as for a test taken on Saturday. (This is because the cost of a weekday evening test will be the same as the cost of a Saturday test.) Thus, the fee for an ordinary driving test taken on a weekday after 4.30pm will be - (a) £44 in the case of a test of competence to drive a motorcycle or a moped, and (b) £35 in the case of any other test: see regulation 4.
Finally, from 14th August 1992 the charge for forms of certificates evidencing the successful completion of an approved training course for motorcyclists will be increased from £2.10 to £5.00 per form: see regulation 5.

1988 c. 52; section 89(3)(a) was amended by section 48 of, and paragraph 63 of Schedule 4 to, the Road Traffic Act 1991 (c. 40) on 1st July 1992 (see the Road Traffic Act 1991 (Commencement No. 4 and Transitional Provisions) Order 1992 (S.I. 1992/1286)); sections 89(4)(b) and 97(3A)(e) are to be read with the Department of Transport (Fees) Order 1988 (S.I. 1988/643), where the relevant entries are to be found in Schedule 1, Table VI (see items 1A and 4). Table VI was inserted by the Department of Transport (Fees) (Amendment) Order 1991 (S.I. 1991/811) on 1st April 1991; section 97(3A) was inserted by section 6 of the Road Traffic Driver Licensing and Information Systems) Act 1989 (c. 22) on 1st December 1990 (see the Road Traffic Act (Driver Licensing and Information Systems) Act 1989 (Commencement No. 3) Order 1990 (S.I. 1990/2228)).
