INDUSTRIAL ORGANISATION AND DEVELOPMENT

The Horticultural Development Council (Amendment) Order 1992

The Minister of Agriculture, Fisheries and Food and the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by section 8(1) of the Industrial Organisation and Development Act 1947(1), and now vested in them(2), and of all other powers enabling them in that behalf, after consultation with the Horticultural Development Council (established under the said Act by the Horticultural Development Council Order 1986(3)), with the organisations appearing to them to be representative of substantial numbers of persons carrying on business in the industry and with the organisations representative of persons employed in the industry appearing to them to be appropriate, hereby make the following Order, a draft of which has been laid before and approved by resolution of each House of Parliament-

Title and Commencement

1. This Order may be cited as the Horticultural Development Council (Amendment) Order 1992 and shall come into force on the day after the day on which it is made.

Further amendment of the Horticultural Development Council Order 1986

2. The Horticultural Development Council Order 1986 (hereinafter called "the principal Order") shall be further amended in accordance with the following provisions of this Order.

3. In article 4 of the principal Order-

(a)in paragraph (1), for the word "sixteen" there shall be substituted the word "eleven";

(b)in paragraph (2), for the words "two persons" there shall be substituted the words "one person";

(c)for paragraph (3) there shall be substituted the following paragraph-

"(3)one person as to whom the Ministers are satisfied that he has no such financial or industrial interest as is likely to affect him in the discharge of his functions as a member of the Council (hereinafter referred to as an "independent member"); and"

(d)in paragraph (4), for the words "two persons" there shall be substituted the words "one person".

4. In paragraph 3 of Schedule 3 to the principal Order for the word "eight" there shall be substituted the word "five".

In witness whereof the official seal of the Minister of Agriculture, Fisheries and Food is hereunto affixed on 21st July 1992.

Explanatory Note

(This note is not part of the Order)

This Order, which comes into force on 23rd July 1992, amends for the second time the Horticultural Development Council Order 1986 ( "the principal Order").

Amendments made by the Order have the effect of reducing the number of members of the Council appointed by the Ministers from twenty-two to fourteen and the quorum of the Council from a minimum of eight persons to a minimum of five (articles 3 and 4).
