The Secretary of State for Health in exercise of powers conferred by sub-paragraph (5) of paragraph 2 of Schedule 4 to the Children Act 1989(1) and of all other powers enabling her in that behalf, after consultation in accordance with that sub-paragraph with the Congregation of the Poor Servants of the Mother of God, the voluntary organisation by which the assisted community home, St Gabriel's, Knolle Park, Woolton, Liverpool is provided and with the Council of the City of Liverpool, the local authority specified in the St Gabriel's, Knolle Park, Woolton, Liverpool Instrument of Management Order 1973(2), hereby makes the following Order:-

Citation and commencement

1.-(1) This Order may be cited as the St Gabriel's, Knolle Park, Woolton, Liverpool Instrument of Management (Variation) Order 1992 and shall come into force on8th October 1992.

Variation of Order

2. For Article 3 of the St Gabriel's, Knolle Park, Woolton, Liverpool Instrument of Management Order 1973 there shall be substituted the following-

"Purpose and nature of home

3.-(1) The purpose of the home shall, subject to paragraph (2) of this Article, be-

(a)to provide accommodation for children looked after by a local authority who have attained the age of two years but who have not attained the age of sixteen years at the date of their admission to the home;

(b)to provide accommodation for persons for whom a local authority may provide accommodation pursuant to subsection (5) of section 20 (provision of accommodation for those who are 16 but under 21) of the Children Act 1989(3);

(c)to provide two units for accommodating-

(i)mothers who are being looked after by a local authority and their children;

(ii)mothers for whom a local authority is making available advice and assistance under section 24 of the Children Act 1989(4) (advice and assistance for certain children) and their children.

(2) The total number of all persons accommodated in the home at any one time shall not exceed sixty and the total number of mothers accommodated at any one time in any one unit under paragraph (1)(c) of this Article shall not exceed six.

(3) The home shall be of such a nature that facilities are provided for the care, treatment and training of persons accommodated there."

Explanatory Note

(This note is not part of the Order)

This Order varies the Instrument of Management for the assisted community home known as St Gabriel's, Knolle Park, Woolton, Liverpool. It makes provision to make available accommodation to young persons who have reached the age of sixteen but are under twenty-one to safeguard and promote their welfare, and provides for two separate units each of which may accommodate up to six mothers who are looked after by a local authority (and their children) and/or mothers for whom a local authority is making available advice and assistance under the Children Act 1989 and their children.
