The Secretary of State, in exercise of powers conferred on him by sections 19, 27 and 108(1) of the National Health Service (Scotland) Act 1978(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1.-(1) These Regulations may be cited as the National Health Service (General Medical and Pharmaceutical Services) (Scotland) Amendment (No.2) Regulations 1992 and shall come into force on 2nd November 1992.
(2) In these Regulations "the principal Regulations" means the National Health Service (General Medical and Pharmaceutical Services) (Scotland) Regulations 1974(2).
2. In Schedule 2A to the principal Regulations (drugs and other substances not to be supplied by general medical practitioners or prescribed for supply under pharmaceutical services)-
(a)the following entries shall be deleted:-

Cyanocobalamin Tablets (any strength)

each of the following entries shall be inserted at such points in the alphabetical order as are appropriate having regard to the initial letter of each entry:-

3. For Schedule 2B to the principal Regulations (drugs to be supplied by general medical practitioners or prescribed for supply under pharmaceutical services only in certain circumstances) there shall be substituted the following Schedule:-

Carbocisteine | A patient under the age of 18 who has undergone a tracheostomy | Any condition which, through damage or disease, affects the airways and has required a tracheostomy |
Clobazam | Any patient | Epilepsy |
Cyanocobalamin Tablets | Any patient who is a vegan or who has a proven vitamin B12 deficiency of dietary origin | Treatment or prevention of vitamin B12 deficiency |
Pregnavite Forte F Tablets | A woman who has previously given birth to a child (whether or not born alive) with a defect of the neural tube or aborted a foetus with such a defect | Reduction of the risk of spina bifida or anencephaly in a child which may be born to the patient". |

(This note is not part of the Regulations)
These Regulations, which come into force on 2nd November 1992, amend the National Health Service (General Medical and Pharmaceutical Services) (Scotland) Regulations 1974 ("the principal Regulations") which regulate the terms on which doctors and chemists provide general medical services and pharmaceutical services under the National Health Service (Scotland) Act 1978.
Schedule 2A to the principal Regulations list drugs and other substances which cannot be supplied by doctors, or prescribed for supply under pharmaceutical services. Regulation 2 deletes certain substances from, and adds other substances to, that Schedule.
Schedule 2B to the principal Regulations lists certain drugs which may be prescribed under the NHS but only for specific clinical conditions. Regulation 3 in substituting that Schedule includes a new drug, Cyanocobalamin Tablets.
1978 c. 29; section 19 was amended by the Health Services Act 1980 (c. 53) ("the 1980 Act"), section 7, by the Health and Social Services and Social Security Adjudications Act 1983 (c. 41), Schedule 7, paragraph 2, by the Medical Act 1983 (c. 54), Schedule 5, paragraph 17(a) and by the National Health Service and Community Care Act 1990 (c. 19) ("the 1990 Act"), section 37; section 27 was amended by the 1980 Act, section 20(2), by the National Health Service (Amendment) Act 1986 (c. 66), section 3(3) and by the 1990 Act, Schedule 9, paragraph 19(7); seesection 108(1) for definitions of "prescribed" and "regulations".
