The Secretary of State for Transport, in exercise of the powers conferred by section 54(1) and 61 of the Road Traffic Act 1988(1) and of all other enabling powers, and after consultation with representative organisations and in accordance with section 195(2) of the Road Traffic Act 1988, hereby makes the following Regulations-

Citation and Commencement

1. These regulations may be cited as the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) (Amendment) Regulations 1992 and shall come into force on 1st February 1992.

Preliminary

2. The Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982(2) shall be further amended in accordance with the following provisions of these Regulations.

Amendments relating to the classes of vehicles to which the principal Regulations apply

3. In sub-paragraphs (q) and (r) of regulation 3(2) for the words "the weight of which unladen does not exceed 1525" there shall be substituted the words "the maximum gross weight of which does not exceed 3500".

Amendments relating to Speed Limiter

4. After item 8 in Schedule 1, there shall be added the following item-

"9.Speed limitersConstruction and Use Regulations(3)

Design, construction and equipment requirements in regulation 36B, paragraph (2) and either-

(a)

paragraph (3)(a), or

(b)

paragraph (4) excluding the requirement relating to calibrations

Vehicles with a maximum gross weight of less than 7500 kg.1.2.1992
or
These RegulationsRequirements relating to maximum speed specified in the note below.
Note: A vehicle meets the requirements relating to maximum speed referred to above if it has a maximum speed (within the meaning of the Construction and Use Regulations) of less than 60 miles per hour."

Explanatory Note

(This note is not part of the Regulations)

1. These Regulations further amend the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982.

2. Regulation 3(2) (q) and (r) of the 1982 Regulations exempted certain vehicles from the application of those Regulations if they had an unladen weight of less than 1525 kilograms. These Regulations amend those provisions so that exemption no longer depends on a vehicle's unladen weight but on whether it has a maximum gross weight of less than 3500 kilogrammes. "Maximum gross weight" is defined in regulation 2(1) of the 1982 Regulations.

3. Regulation 4 adds a new type approval requirement for goods vehicles with a maximum gross weight of 7.5 tonnes or more. In order to comply with the requirements a vehicle either has to have a maximum speed of less than 60 mph or be fitted with a speed limiter which satisfies certain conditions.

4. These Regulations refer to regulation 36B of the Construction and Use Regulations. "Construction and Use Regulations" is defined in the 1982 Regulations as the Road Vehicles (Construction and Use) Regulations 1986 (S.I. 1986/1078). Regula tion 36B of the 1986 Regulations was inserted by S.I. 1991/1527.
