The Secretary of State in exercise of the powers conferred on him by section 22(1) of the Crofters (Scotland) Act 1955(1), section 14(1) of the Crofters (Scotland) Act 1961(2), and section 12(6) of the Crofting Reform (Scotland) Act 1976(3) and of all other powers enabling him in that behalf, and after consultation with the Crofters Commission and with the approval of the Treasury, hereby makes the following Scheme:
1. This Scheme may be cited as the Crofting Counties Agricultural Grants (Scotland) Amendment Scheme 1992 and shall come into force on 1st January 1993.
2. The Crofting Counties Agricultural Grants (Scotland) Scheme 1988(4) ("the principal Scheme") shall be amended as follows;-
For item 2 of Column 1 of the Schedule there shall be substituted the following:-
"2. Improvement of land (excluding heathland or moorland) by regeneration, re-seeding, laying down to permanent pasture or reconditioning.".
3. This Scheme shall not apply in relation to an application under article 5 of the principal Scheme by a crofter received by the Secretary of State on or before 31st March 1993 where part of the common grazing has been apportioned to that crofter under section 27 of the Crofters (Scotland) Act 1955(5) on or after 1st January 1990 but before the coming into force of this Scheme.

The Crofting Counties Agricultural Grants (Scotland) Scheme 1988 provides that the Secretary of State may make grants to Crofters and certain other occupiers of land in the crofting counties for certain specified purposes.
This Scheme excludes heathland and moorland from the type of land which can be improved with grant assistance (article 2). The Scheme however contains a saving in respect of crofters who have had part of the common grazings apportioned to them by the Crofters Commission between 1st January 1990 and the date of coming into force of this Scheme who may continue to apply for grant assistance in respect of such land until 31st March 1993 (article 3).
