The Secretary of State for Transport, in exercise of the powers conferred by section 80(1) of the Road Traffic Act 1988(1), and of all other enabling powers, and after consultation with representative organisations in accordance with the provisions of section 195(2) of that Act, hereby makes the following Regulations:-�
1. These regulations may be cited as the Motor Vehicles (Designation of Approval Marks) (Amendment) Regulations 1992 and shall come into force on 1st April 1992.
2. The Motor Vehicles (Designation of Approval Marks) Regulations 1979(2) shall be further amended in accordance with the following provisions of these Regulations.
3. In Schedule 4 after item 29 there shall be added the following item-�
"30 | Spray Suppression Device | The Spray Suppression Device | Council Directive 91/226/EEC of 27th March 1991 | O.J.L103, 23.4.91, p.5 | 1, 2 and 12" |
4. In Schedule 5 after paragraph 11 there shall be added the following paragraph-�
"12. In the marking relating to item 30 in Schedule 4-�
(a)the number referred to in paragraph 2 above will be placed close to the rectangle, either below the letter "e', or to the left or the right of that letter; and
(b)there shall be added, above and close to the rectangle:-�
(i)the letter "A" if the device is of the energy absorption type, or
(ii)the letter "S" if the device is of the air/water separator type."

These Regulations further amend the Motor Vehicles (Designation of Approval Marks) Regulations 1979 by prescribing a new item 30 in Schedule 4, being a marking relating to spray suppression devices, pursuant to Council Directive 91/226/EEC (of 27th March 1991 (OJ No. L103, 23.4.91, p.5)). A consequential amendment is made to Schedule 5.
