Citation and commencement

1. These Regulations may be cited as the Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Welsh Forms and Particulars) (Amendment) Regulations 1992 and shall come into force on 6th April 1992.

Amendment of Regulations

2.-(1) The forms in the Schedule to the Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Welsh Forms and Particulars) Regulations 1991(4) are amended in accordance with this regulation.

(2) In question 3.13 on Forms 1 and 2 (cwestiwn 3.13 yn Ffurflen 1 a 2) omit the reference to "Nodyn 30" against "lwfans symud-o-gwmpas".

(3) At the end of question 3.13 on Forms 1 and 2 (cwestiwn 3.13 yn Ffurflen 1 a 2) add-

(4) After question 3.13 on Forms 1 and 2 (cwestiwn 3.13 yn Ffurflen 1 a 2) insert the following additional question-

(5) In question 3.17 on Forms 1 and 2 (cwestiwn 3.17 yn Ffurflen 1 a 2) for the words "neu lwfans symud-o-gwmpas" substitute the words ", lwfans symud-o-gwmpas neu lwfans byw i'r anabl".

(6) In question 3.36 on Forms 1 and 2 (cwestiwn 3.36 yn Ffurflen 1 a 2) after the entry for "lwfans gofal analluedd" insert the entry-

(7) In note 29 on Forms 1 and 2 (nodyn 29 yn Ffurflen 1 a 2) for the words "lwfans gweini" substitute the words "y lwfans".

(8) In note 30 on Forms 1 and 2 (nodyn 30 yn Ffurflen 1 a 2) for the words from "lwfans" to "oedran neu" substitute the word "pensiwn".

(9) In note 36 on Forms 1 and 2 (nodyn 36 yn Ffurflen 1 a 2) after the words "lwfans gweini" insert the words ", lwfans byw i'r anabl".

(10) In note 44 on Forms 1 and 2 (nodyn 44 yn Ffurflen 1 a 2) add "lwfans byw i'r anabl" to the end of the list of specified benefits.

(11) In question 3.11 on Form 3 (cwestiwn 3.11 yn Ffurflen 3) omit the reference to "Nodyn 28" against "lwfans symud-o-gwmpas".

(12) At the end of question 3.11 on Form 3 (cwestiwn 3.11 yn ffurflen 3) add-

(16) In note 27 on Form 3 (nodyn 27 yn Ffurflen 3) for the words "lwfans gweini" substitute the words "y lwfans".

(17) In note 28 on Form 3 (nodyn 28 yn Ffurflen 3) for the words from "lwfans" to "oedran neu" substitute the word "pensiwn".

(18) In note 34 on Form 3 (nodyn 34 yn Ffurflen 3) after the words "lwfans gweini" insert the words ", lwfans byw i'r anabl".

(19) In note 42 on Form 3 (nodyn 42 yn Ffurflen 3) add "lwfans byw i'r anabl" to the end of the list of specified benefits.

Transitional

3. In respect of any application for a grant made before 6th April 1992 in accordance with the provisions of the Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Welsh Forms and Particulars) Regulations 1991(5) the provision of those Regulations shall apply as if these Regulations had not come into force.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the forms in the Schedule to the Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Welsh Forms and Particulars) Regulations 1991 (as amended)(6) ("the principal Regulations"). The amendments are a translation into Welsh of the amendments made by the Housing Renovation etc. Grants (Prescribed Forms and Particulars) (Amendment) Regulations 1992 (S.I. 1992/562) to the Housing Renovation etc. Grants (Prescribed Forms and Particulars) Regulations 1990(7) in relation to disability living allowance and disability working allowance.

Regulation 2(2) omits reference to "Note 30" against "mobility allowance" in question 3.13 on Forms 1 and 2. Regulation 2(11) contains the same requirement for question 3.11 on Form 3 for "Note 28".

Regulation 2(3) adds to question 3.13 on Forms 1 and 2 in the principal Regulations a requirement to state whether disability living allowance and/or disability working allowance is received. Regulation 2(12) adds to question 3.13 on Form 3 the same requirement. Regulation 2(4) inserts note 3.13A on Forms 1 and 2 asking which level of the disability allowance a person or their partner is receiving. Regulation 2(13) inserts note 3.11A on Form 3.

Regulation 2(5) adds to question 3.17 in Form 1 and 2 a requirement to give details of any disability living allowance. Regulation 2(14) adds to question 3.15 in Form 3 the same requirement.

Regulation 2(6) adds to question 3.36 in Forms 1 and 2 a requirement to give further details about any money received from the disability working allowance for both the claimant and their partner. Regulation 2(15) adds to question 3.34 in Form 3 the same requirement.

Regulation 2(7) amends note 29 on Forms 1 and 2, by substituting the word "attendance" with the word "the". Regulation 2(16) contains the same requirement for note 27 on Form 3.

Regulation 2(8) inserts the word "pension" instead of the word "attendance" to "grounds or". Regulation 2(17) contains the same requirement for note 28 on Form 3.

Regulation 2(9) inserts words at the end of note 36 on Forms 1 and 2. Regulation 2(18) contains the same requirement for note 34 on Form 3.

Regulation 2(10) inserts at the end of note 44 on Forms 1 and 2 the words "disability living allowance". Regulation 2(19) contains the same requirement for note 34 on Form 3.

Regulation 3 (transitional) provides that the amendments do not apply in respect of any application for a grant made in accordance with the provisions of the principal Regulations before the date on which the Regulations come into force.
