1. This Order shall come into force on 19th February 1993 and may be cited as the A30 and A39 Trunk Roads (Indian Queens, Fraddon and St Columb Road Bypasses and Slip Roads) Order 1993.
2. The new highways which the Secretary of State proposes to construct-�
(a)along the routes described in Schedule 1 (the highway along the route described in paragraph 1 of that schedule being in this Order referred to as "the first new trunk road", and the route described in paragraph 2 of that schedule being in this Order referred to as "the second new trunk road"), and
(b)along the routes described in Schedule 2, which connect the first new trunk road and the second new trunk road with other highways at the places stated in that schedule (the highways along these routes being in this Order referred to as "the slip roads"),
shall become trunk roads as from the date when this Order comes into force.
3. The centre line of each of the new trunk roads is indicated by a heavy black line on the deposited plan.
4. The Secretary of State directs as respects any part of a highway which crosses the route of a new trunk road that-�
(a)where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority, and
(b)where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for the purpose of through traffic.
5. In this Order:
(1) all measurements of distance are measured along the route of the relevant highway;
(i)"the deposited plan" means the plan numbered HA10/2/SWM77 marked "The A30 and A39 Trunk Roads (Indian Queens, Fraddon and St Columb Road Bypasses and Slip Roads) Order 1993", signed by authority of the Secretary of State for Transport and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;
(ii)"the new trunk roads" means the highways mentioned in article 2 of this Order and "a new trunk road" means one of those highways;
(iii)"the A30" means the A30 London-Penzance Trunk Road;
(iv)"the A39" means the A39 Taunton-Fraddon Trunk Road; and
(v)"the side roads order" means the A30 and A39 Trunk Roads (Indian Queens, Fraddon and St Columb Road Bypasses and Slip Roads Side Roads) Order 1993;
(3) A reference to a schedule followed by a number is a reference to the schedule to this Order which bears that number.

The routes of the first new trunk road and the second new trunk road are in the Borough of Restormel in the County of Cornwall and are:-�
1. The first new trunk road, between Penhale and Indian Queens, is about 4.76 kilometres in length, commencing from a point on the A30 approximately 115 metres east of its junction with the C185 road to St Enoder and proceeding in a north-easterly direction to a point on the A30 approximately 10 metres east of its junction with the unclassified road to Ruthvoes.
2. The second new trunk road, between Indian Queens and Black Cross, is about 3.46 kilometres in length, commencing with a roundabout under the first new trunk road (the centre point of that roundabout being approximately 300 metres south of the boundary of the A30 and south-east of the cemetery) and proceeding north-westwards to a point on the A39 approximately 115 metres north of its junction with the C376 road to Newquay, at Black Cross. This route comprises a roundabout, at Trevarren, connecting with the A39 and a new highway (linking with the A392 road to Newquay) which is to be constructed by the Secretary of State pursuant to the side roads Order.
The routes of the slip roads are as follows:-�
1. Junction with the C008 road to Tregony, at Penhale
(a)A route to connect the westbound carriageway of the first new trunk road with the C008 road to Tregony (to be improved by the Secretary of State pursuant to the side roads Order). The slip road along this route is given the reference number 1 on the deposited plan.
(b)A route to connect the eastbound carriageway of the first new trunk road with a new highway (linking with the A30 and the C008 road to Tregony) to be constructed by the Secretary of State pursuant to the side roads Order. The slip road along this route is given the reference number 2 on the deposited plan.
2. Junction of the first new trunk road with the second new trunk road, at Indian Queens
(a)A route to connect the roundabout at the south-eastern end of the second new trunk road with the westbound carriageway of the first new trunk road. The slip road along this route is given the reference number 3 on the deposited plan.
(b)A route to connect the eastbound carriageway of the first new trunk road with that roundabout. The slip road along this route is given the reference number 4 on the deposited plan.
(c)A route to connect that roundabout to the eastbound carriageway of the first new trunk road. The slip road along this route is given the reference number 5 on the deposited plan.
(d)A route to connect the westbound carriageway of the first new trunk road with that roundabout. The slip road along this route is given the reference number 6 on the deposited plan.
