The Smoke Control Areas (Exempted Fireplaces) Order 1993

The Secretary of State, in exercise of the powers conferred by section 21 of the Clean Air Act 1993(1), being satisfied that the classes of fireplace described in the Schedule hereto can be used for burning fuel other than authorised fuels without producing any smoke or a substantial quantity of smoke, hereby makes the following Order-�

Citation and commencement

1. This Order may be cited as the Smoke Control Areas (Exempted Fireplaces) Order 1993 and shall come into force on 18th October 1993.

Classes of fireplace exempted from section 20 of the Clean Air Act 1993

2. The classes of fireplace described in the Schedule shall, upon the conditions there specified, be exempted from the provisions of section 20 of the Clean Air Act 1993 (which prohibits smoke emissions in smoke control areas).

SCHEDULE

Class of fireplaceConditions
The Apollo incinerator types 10, 25 and 50 manufactured by Apollo Incineration Systems Limited.

1. The incinerators shall be installed, maintained and operated in accordance with the manufacturer's instructions dated 2nd November 1992 and bearing the reference "Apollo 10-�25-� 50".

2. No fuel shall be used other than wood, wood shavings, cardboard and polythene.

The Clearview models 650 and 750, and the Vision 500 model, manufactured by Clearview Stoves.

1. The fireplaces shall be installed, maintained and operated in accordance with the manufacturer's instructions dated 1st January 1993 and, in the case of the Clearview models 650 and 750, bearing the reference "1/42" and, in the case of the Vision 500 model, bearing the reference "V1/42".

2. No fuel shall be used other than firewood which has been split, stacked and air dried.

The Farm 2000 boilers HT60, HT70, HT80 and BB154/2V manufactured by Farm 2000 Limited.

1. The boilers shall be installed, maintained and operated in accordance with the manufacturer's instructions which, in the case of models HT60, HT70 and HT80, are dated 1st July 1993 and bear the reference "HT60/70/80", and, in the case of model BB154/2V, are dated 1st September 1993 and bear the reference "9/93".

2. No fuel shall be used other than cereal straw.

Explanatory Note

(This note is not part of the Order)

Section 18 of the Clean Air Act 1993 empowers local authorities to declare the whole or any part of their district to be a smoke control area. Section 20 of the Act generally prohibits the emission of smoke in smoke control areas. By order made under section 21 of the Act specified classes of fireplace may be exempted from the provisions of section 20.

This Order, which applies throughout Great Britain, exempts the classes of fireplace mentioned in the Schedule from the provisions of section 20 subject to conditions requiring installation, maintenance and operation in accordance with the relevant manufacturer's instructions and subject to certain conditions as to the fuel to be used. If these instructions cannot be obtained from the manufacturer, copies may be obtained, free of charge, from the Department of the Environment, Room B350, Romney House, 43 Marsham Street, London SW1P 3PY.
