Explanatory Note

(This note is not part of the Order)

This Order designates those educational institutions in England which are eligible to receive support from funds administered by the Further Education Funding Council for England or by the Further Education Funding Council for Wales.

The Order provides that section 29 of the Further and Higher Education Act 1992 ("the Act") does not apply to the Workers' Educational Association (with the consequence that its instrument and articles of government do not have to satisfy the requirements of that section).

The Order also specifies the institutions in relation to which section 32 of the Act (transfer of property etc) is to have effect and identifies the trustees to whom the property and rights referred to in that section are to be transferred. In the case of one college it specifies the trust deed under the trusts of which they are to be held. In the case of the other colleges, where no trust deed is specified, section 33(1) of the Act provides that property and rights transferred are to be held on trust for the general purposes of the institution.
