The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by sections 131(3) and 137(2) of the Local Government and Housing Act 1989(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Assistance for Minor Works to Dwellings (Amendment) Regulations 1993 and shall come into force on 5th April 1993.

Application of Regulations

2.-(1) These Regulations apply in relation to applications for assistance made on or after 5th April 1993.

(2) In paragraph (1) "assistance" means assistance (whether in the form of a grant or the provision of materials) under section 131 of the Local Government and Housing Act 1989.

Amendment of Regulations

3. The Assistance for Minor Works to Dwellings Regulations 1990(2)are amended-

(a)in paragraph (1)(c) of regulation 4 (persons to whom assistance may be given), by substituting for the words "or community charge benefit (within the meaning of section 20 of the Social Security Act 1986)"(3) the words ", council tax benefit or disability working allowance (within the meaning of Part VII of the Social Security Contributions and Benefits Act 1992)"(4);

(b)in paragraph (2) of regulation 5 (dealing with applications), by substituting for the words "regulation 6" the words "regulations 6 and 7";

(c)in regulation 6 (amount of assistance)-

(i)in paragraph (1), by substituting for the words "The total" the words "Subject to regulation 7, the total"; and

(ii)in paragraphs (2) and (3), by substituting "£1,080" for "£1,000"; and

(d)by adding, after regulation 6, the following-

"Amount of assistance: further provision

7. The sum determined for the purposes of paragraph (b) of section 131(2) of the Act (sum which total amount or value of assistance given under section 131 of the Act in any period of three years in respect of any one dwelling must not exceed) is £3,240.".

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Assistance for Minor Works to Dwellings Regulations 1990 which deal with assistance given by local housing authorities under section 131 of the Local Government and Housing Act 1989. The amendments are made by regulation 3 and, by virtue of regulation 2, have effect in relation to applications for assistance made on or after the date these Regulations come into force.

The amendment to regulation 4 of the 1990 Regulations (persons to whom assistance may be given) substitutes a reference to council tax benefit and disability working allowance for the reference to community charge benefit.

The amendments to regulation 6 and the new regulation 7 relate to financial limits. The maximum amount or value of assistance which may be given under section 131 on any one application for assistance is increased from £1,000 to £1,080. The maximum amount of assistance which may be given over a three year period in respect of the same dwelling is increased from £3,000 to £3,240. The amendment to regulation 5 is consequential on the new regulation 7.
