Whereas a draft of this Order has been approved by a resolution of the House of Commons in pursuance of section 102(5) of the Finance (No. 2) Act 1987(1):
Now, therefore, the Lord Chancellor, in exercise of the powers conferred by section 102 of that Act, hereby makes the following Order:
1.-(1) This Order may be cited as the Land Registration (Determination of Costs) Order 1993 and shall come into force on 1st April 1993.
(2) In this Order "the 1925 Act" means the Land Registration Act 1925(2).
2. In relation to the power under section 145(3)of the 1925 Act to make orders with respect to the amount of fees payable under that Act, the following matter, namely a requirement to secure a return on the resources employed in the working of the 1925 Act, is hereby specified for the purposes of section 102(4) of the Finance (No. 2) Act 1987 as one which is to be taken into account in determining the costs of the functions which fall to be taken into account on the exercise of that power.
