1.-(1) These Regulations may be cited as the Education (Distribution by Schools of Information about Further Education Institutions) (Wales) Regulations 1994 and shall come into force on 7th June 1994.
(2) These Regulations apply in relation to institutions in Wales only.
2. The governing body of every maintained, grant-maintained or grant-maintained special school which provides secondary education shall provide the categories of information specified in regulation 3 below to the persons specified in regulation 4 below.
3. The information to be provided is that published by the governing body of an institution within the further education sector under section 50 of the Further and Higher Education Act 1992(4) and made available by them for distribution by the governing body of the school.
4. The information shall be provided by the governing body of the school in the form in which it is received for distribution from the governing body of the institution within the further education sector,-
(a)to all pupils who are in the second year of the fourth key stage(5), or
(b)if the number of copies of the information made available for distribution is less than the number of such pupils, to such number of pupils as the number of copies supplied allows, on a basis determined by the governing body.
5. When the information relates to an academic year ending on 31st July 1993 (or earlier) it shall be provided by the governing body of the school on or before 14th June 1994 and when it relates to any other academic year it shall be so provided on or before the expiration of a period of four weeks commencing on the 2nd January immediately following the date on which the information was published by the governing body of the institution within the further education sector.
6. The duties imposed on a governing body by virtue of the foregoing provisions of these Regulations in respect of the provision of information apply only to the extent that that information is available to the governing body before the latest occasion on which the information is required to be provided. Amendment of the Education (Further Education Institutions Information) (Wales) Regulations 1993.
7.-(1) The Education (Further Education Institutions Information) (Wales) Regulations 1993 shall be amended as set out in this regulation.
(2) In the definition of "maintained secondary school" in regulation 2(1), there shall be added after the words "grant-maintained school", the words "or a grant-maintained special school".

These Regulations require the governing body of every county, voluntary, grant-maintained school or grant-maintained special school in Wales which provides secondary education to provide information to pupils with respect to institutions within the further education sector. The information to be provided takes the form of copies of the information made available to the school for distribution, pursuant to section 50 of the Further and Higher Education Act 1992, by the governing bodies of institutions within the further education sector in Wales. The copies are to be given by the governing body of the school to all pupils who are in the second year of the fourth key stage. If the governing body of an institution within the further education sector does not provide enough copies for such pupils to each have one, the governing body of the school will determine how such copies as are provided are to be distributed amongst such pupils.
The publication of information pursuant to section 50 of the Further and Higher Education Act 1992 is in Wales governed by the Education (Further Education Institutions Information) (Wales) Regulations 1993. They require the governing bodies of institutions within the further education sector in Wales to publish information about the educational achievements of their students and their careers after completing their courses. Those regulations are amended so that grant-maintained special schools are included in the list of schools to which information must be provided.

The current Regulations dealing with the publication of information under section 50 by institutions in Wales are the Education (Further Education Institutions Information) (Wales) Regulations 1993 (S.I. 1993/2169) and they are amended by these Regulations.
