The Police (Number of Members of Police Authorities) Order 1994

Coming into force in accordance with article 1(2)

In exercise of the power conferred upon me by section 3A(2) of the Police Act 1964(1), I hereby make the following Order:

1.-(1) This Order may be cited as the Police (Number of Members of Police Authorities) Order 1994.

(2) This Order shall come into force on such days and for such purposes as section 3 of the Police and Magistrates' Courts Act 1994(2) (by which section 3A of the Police Act 1964 is inserted) is brought into force by order under section 94(1) of that Act of 1994.

2. The number of members of each of the following police authorities established under section 3 of the Police Act 1964(3), namely-�

(a)the Devon and Cornwall Police Authority;

(b)the Greater Manchester Police Authority, and

(c)the Dyfed Powys Police Authority,

shall be nineteen, of which six members shall be persons appointed under paragraph 5 of Schedule 1B to that Act(4) (and accordingly by virtue of paragraph 1(2)(a) and (c) of that Schedule, ten members shall be members of a relevant council, within the meaning of paragraph 27 of that Schedule, appointed under paragraph 2 of it and the remainder shall be magistrates appointed under paragraph 8 of it).

Explanatory Note

(This note is not part of the Order)

This Order increases the number of members of the Devon and Cornwall, Greater Manchester and Dyfed Powys Police Authorities. These Authorities will be established under section 3 of the Police Act 1964 (as substituted by section 2 of the Police and Magistrates' Courts Act 1994) when that provision is brought into force.

By virtue of section 3A(1) of the 1964 Act (as inserted by section 3(1) of the 1994 Act) police authorities established under new section 3 of the 1964 Act will consist of seventeen members. This is subject to the power in section 3A(2) (which is exercised in this Order) to increase the number of members. In such a case, paragraph 1(2) of Schedule 1B to the 1964 Act (as inserted by Schedule 2 to the 1994 Act) determines the composition of the police authorities.

The provisions of the 1994 Act by which the new police authorities are established will be brought into force for the purposes of the appointment of members of those authorities and the discharge of certain functions before those provisions are brought into force for the purpose of the new police authorities taking over the functions of existing police authorities.
