In exercise of the powers conferred by sections 162(2) and 301(6) of the Education Act 1993(1), the Secretary of State for Education hereby makes the following Regulations:
1. These Regulations may be cited as the Education (Payment for Special Educational Needs Supplies) (Amendment) Regulations 1994 and shall come into force on 7th September 1994.
2. Regulation 2 of the Education (Payment for Special Educational Needs Supplies) Regulations 1994(2)shall be amended-
(a)by the insertion at the beginning of paragraph (2) of the words "Subject to paragraph (4) below"; and
(b)by the addition after paragraph (3) of the following paragraph-
"(4) Paragraph (2) above shall have effect in relation to the maintenance grant for a grant-maintained special school for the financial year beginning in 1994 with the omission in sub-paragraph (a)(ii) of that paragraph of the words "the financial year immediately preceding".".

These Regulations amend the Education (Payment for Special Educational Needs Supplies) Regulations 1994, so that for the 1994-95 financial year the maintenance grant of a grant-maintained special school is to be taken to include an amount for meeting the costs of goods or services supplied by local education authorities under section 162(1) of the Education Act 1993 where such an amount is included in Part I of the authority's statement under section 42(3) of the Education Reform Act 1988 for that financial year (rather than the authority's statement for the immediately preceding financial year).
