CONTAMINATION OF FOOD

The Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) (Partial Revocation) Order 1994

Whereas the Secretary of State was of the opinion, as mentioned in section 1(1)(a) of the Food and Environment Protection Act 1985(1), that there had been or might have been circumstances which were likley to create a hazard to human health through human consumption of food;

And whereas the Secretary of State was of the opinion, as mentioned in section 1(1)(b) of the said Act, that in consequence of the said circumstances food which was or might have been in the future derived from sheep in the areas described in Schedule 1 to the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) Order 1991(2), was, or might have been, or might have become, unsuitable for human consumption;

And whereas the Secretary of State is now of the opinion that food which is derived or may in the future be derived from sheep in the areas referred to in article 2(1) of this Order is no longer unsuitable for human consumption in consequence of the said circumstances;

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 1(1) and (2) and section 24(1) and (3) of the said Act(3), and of all other powers enabling him in that behalf, hereby makes the following Order:-�

Title and commencement

1. This Order may be cited as the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) (Partial Revocation) Order 1994 and shall come into force on 19th January 1994.

Partial revocation

2.-(1) The Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) Order 1991 is hereby revoked-�

(a)with respect to those parts of the designated area numbered 1 of Schedule 1 to that Order which are set out in Part I of the Schedule to this Order; and

(b)with respect to the designated area numbered 14 of Schedule 1 to that Order.

(2) In consequence of that revocation that Order shall be amended as follows-�

(a)for paragraph 1 of Schedule 1 there shall be substituted the paragraphs set out in Part II of the Schedule to this Order;

(b)in article 6(1)(a)(i) and 6(1)(b)(i), immediately after the word "1,", there shall be inserted the word "1A,"; and

(c)the word "14", in article 6(1)(a)(v) and 6(1)(b)(v) shall be omitted.

From where the Nant Nadroedd meets the forest boundary at OS map reference SH 943262 generally south-�eastwards along the Nant Nadroedd to where it meets the fence at OS map reference SH 944262 south-�westwards then south-�eastwards passing through OS map reference SH 943259 to where it meets a fence at OS map reference SH 958253 then following the fence generally north-�eastwards to where it meets the track at OS map reference SH 962254 then south-� eastwards then generally south-�westwards to its intersection with another track at OS map reference SH 964244 at Rhiwargor then following the track generally southwards to where it meets the fence at OS map reference SH 965241 then following the fence south-�eastwards to where it meets the shore line of Llyn Efyrnwy at OS map reference SH 966241 then generally westwards then south-�westwards along the shore line passing through OS map references SH 968229, SH 970221 and SH 980213 to where it joins the stream at OS map reference SH 994206 and then crossing Llyn Efyrnwy in a generally north-�westwards direction to the forestry boundary at OS map reference SH 988217 and then following the forestry boundary to its junction with the stream at OS map reference SH 993225 and then generally eastwards following the course of the stream through the forest to its junction with the stream at OS map reference SH 999222 and then generally north-�eastwards following the course of the stream to where it meets the forestry boundary at OS map reference SJ 004224 and then generally north-�eastwards following the forest boundary to where it joins the fenced forestry boundary at OS map reference SJ 003226 and then generally north-�eastwards following the fenced forestry boundary to where it joins the Severn-� Trent Boundary at OS map reference SJ 012240 and then generally north-�westwards along the Severn-�Trent Boundary passing through OS map references SJ 004244 and SJ 003260 to where it joins the fence at the County Boundary at OS map reference SH 988279 at Cyrniau Nod; then westwards and then south-�westwards along the fence following the County Boundary passing through OS map reference SH 945270 to where it meets the Nant Nadroedd at OS map reference SH 943262.

2. From the junction of the two fences at OS map reference SH 924243 eastwards along the fence to OS map reference SH 936243 then southwards to where it meets the fence at OS map reference SH 935238 and then generally south-�eastwards along the fence passing through OS map reference SH 950227 to where it meets the shore of Llyn Efyrnwy at OS map reference SH 963224 and then following the shore line south-�eastwards to where it meets the Afon Hirddu at OS map reference SH 975214 and then following the Afon Hirddu generally westwards to where it meets the fence at OS map reference SH 960211 and then following the fence generally westwards then south-�westwards until it meets a fence at OS map reference SH 928199 and then generally northwards passing though OS map references SH 925209, SH 922219, SH 916229 and SH 920238 to where it meets the fence at OS map reference SH 924243.

3. From the junction of the two fences at OS map reference SH 927197 generally eastwards along the fence passing through OS map reference SH 941194 and then generally south-�eastwards then southwards then south-�westwards to where it meets the fence at OS map reference SH 936164 continuing south-�westwards then north-�westwards along the fence passing through OS map references SH 931166, SH 927174 and SH 925187 to its junction with a fence at OS map reference SH 927197.

4. From the junction of the two fences at OS map reference SH 978175 generally north-� eastwards to where it meets a fence at OS map reference SH 989179 then following the fence south-�eastwards to where it meets the fence at OS map reference SH 997175 then following the fence south-�westwards to its junction with a fence at OS map reference SH 992170 then following the fence north-�westwards to its junction with a fence at OS map reference SH 978175.

PART IIthose parts of the area numbered 1 of schedule 1 to the food protection (emergency prohibitions) (radioactivity in sheep) (wales) order 1991 remaining designated

Explanatory Note

(This note is not part of the Order)

This Order further partially revokes the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) Order 1991 ("the principal Order") which contains emergency prohibitions restricting various activities in order to prevent human consumption of food which has been or which may have been rendered unsuitable for that purpose in consequence of the escape of radioactive substances from a nuclear reactor situated at Chernobyl in the Ukraine.

This partial revocation reduces a designated area in the County of Powys subject to the restrictions set out in the principal Order and also provides that a designated area in the County of Gwynedd is no longer subject to the said restrictions.

Maps showing the areas which are designated by the principal Order and the areas derestricted by this Order are available for inspection during normal office hours at the offices of the Welsh Office Agriculture Department at Penrallt, Caernarfon, Gwynedd LL55 1EP; Government Buildings, Spa Road East, Llandrindod Wells, Powys LD1 5HA and Cathays Park, Cardiff, South Glamorgan CF1 3NQ.
