The Secretary of State in exercise of the powers conferred on him by section 3(2) of the State Hospitals (Scotland) Act 1994(1) and of all other powers enabling him in that behalf, hereby makes the following Order:
1. This Order may be cited as the State Hospitals (Scotland) Act 1994 Commencement Order 1995.
2. The State Hospitals (Scotland) Act 1994 shall come into force on 1st April 1995.

This Order brings into force on 1st April 1995 the provisions of the State Hospitals (Scotland) Act 1994.
These provisions substitute a new section 102 of the National Health Service (Scotland) Act 1978 (c. 29) in relation to the provision, control and management of state hospitals in Scotland and consequentially repeal certain provisions of the Mental Health (Scotland) Act 1984 (c. 36). As a result powers to make orders under the 1978 Act are exercisable for the purpose of constituting Special Health Boards in relation to state hospitals.
Accordingly, there also comes into force on 1st April 1995 the State Hospitals Board for Scotland Order 1995 (S.I. 1995/574) and the Mental Health (State Hospital Management Committee, State Hospital, Carstairs) (Scotland) Transfer and Dissolution Order 1995 (S. 1995/575">1995/575).
