The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:
1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (Gosport Borough Council) Order 1996 and shall come into force on 24th July 1996.
2.-(1) Cleaning (other than the cleaning of buildings), and the repair and maintenance of vehicles, shall not be treated as defined activities so long as they are carried out by the council of the borough of Gosport ("the authority") in their area before 1st April 1997.
(2) The maintenance of ground by the authority shall not be treated as a defined activity so long as it is carried out in their area during the period beginning on 1st January 1997 and ending with 31st March 1997.

Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled.
This Order exempts from the requirements of Part I, (i) cleaning (other than the cleaning of buildings) and the repair and maintenance of vehicles by the Gosport Borough Council, so long as those activities are carried out in the authority's area before 1st April 1997, and (ii) the maintenance of ground, so long as it is carried out by that authority in their area during the period beginning on 1st January 1997 and ending with 31st March 1997.
