CONTRACTING OUT

The Contracting Out (Administration of Civil Service Pension Schemes) Order 1996

Coming into force

5th July 1996

Whereas a draft was laid before Parliament and approved by resolution of each House of Parliament;

Now, therefore, the Minister for the Civil Service, in exercise of the powers conferred on him by sections 69(2), (3) and (4) and 79 of the Deregulation and Contracting Out Act 1994(1), and having consulted the office-holders whose functions may be affected by it(2), hereby makes the following Order-

Title and commencement

1. This Order may be cited as the Contracting Out (Administration of Civil Service Pension Schemes) Order 1996 and shall come into force on the day after the day on which it is made.

Interpretation

2. In this Order-

"the 1972 Act" means the Superannuation Act 1972(3); and

"the function" means the function conferred by section 1(1)(4) or under section 1(2)(5) of the 1972 Act of administering schemes made under section 1 of that Act and from time to time in force.

Contracting out of function

3. The function may be exercised by (or by employees of) such person as may be authorised in that behalf by the Minister or office-holder whose function it is.

Explanatory Note

(This note is not part of the Order)

Article 3 of this Order enables the Minister for the Civil Service and other Ministers and office-holders who have functions in relation to the administration of Civil Service Pension Schemes under the Superannuation Act 1972 to authorise private contractors to carry out those functions on their behalf to such extent as is specified in the authorisation.

The office-holders who are officers of the Crown to whom functions have been delegated under section 1(2) of the Superannuation Act 1972 and who have been consulted are:- the Chief Registrar of Friendly Societies; the Chief Land Registrar: the Public Trustee; the Chief Charity Commissioner; the Deputy Master of the Mint; The Treasury Solicitor; the Director of Savings; the Registrar General for England and Wales; the Director of Public Prosecutions; the Director of the Serious Fraud Office; the Registrar of Companies for England and Wales; the Registrar of Companies for Scotland; the Comptroller General of Patents; the Director General of Electricity Supply; the Director General of Fair Trading; the Director General of the National Lottery; the Director General of Gas Supply; the Director General of Water Services; Her Majesty's Chief Inspector of Schools in England; Her Majesty's Chief Inspector of Schools in Wales; the Director General of Telecommunications, the Rail Regulator and the Director of Passenger Rail Franchising.

The functions conferred on the Minister for the Civil Service by section 1 of the 1972 Act were vested in the Treasury by virtue of S1 1981/1670, Art3(1)(e). With effect from 1st April 1995, they are vested inthe Minister for the Civil Service by virtue of S.I. 1995/269.

Under section 1(2) of the 1972 Act, the Minister for the Civil Service may delegate his functions under section 1(1) to any other Minister or officer of the Crown.
