The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:
1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (Reigate and Banstead Borough Council) Order 1996 and shall come into force on 21st November 1996.
2. Catering for purposes of schools and welfare(2) shall not be treated as a defined activity so long as-
(a)it consists of the providing of ingredients for, and the preparing of, meals for provision to persons in their own homes under an enactment mentioned in paragraph 4(1)(e) of Schedule 1 to the Local Government Act 1988; and
(b)it is carried out by the council of the borough of Reigate and Banstead during the period beginning with 21st November 1996 and ending with 31st March 1997.
3. Other catering(3) shall not be treated as a defined activity so long as it is carried out by the council of the borough of Reigate and Banstead during the period beginning with 1st April 1997 and ending with 31st December 1997 in the following premises in the borough-
(a)the Donyngs Recreation Centre;
(b)the Banstead Sports Centre; and
(c)the Horley Anderson Centre.

Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if specified conditions are fulfilled.
This Order exempts from the requirements of Part I the carrying out by Reigate and Banstead Borough Council of-
(a)schools and welfare catering undertaken during the period beginning with 21st November 1996 and ending with 31st March 1997 and consisting of catering for meals provided, as part of a statutory welfare service, to persons in their own homes; and
(b)other catering at the premises named in article 3 during the period beginning with 1st April 1997 and ending with 31st December 1997.
