CONTAMINATION OF FOOD

The Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) (Partial Revocation) Order 1996

Whereas the Secretary of State was of the opinion, as mentioned in section 1(1)(a) of the Food and Environment Protection Act 1985(1), that there had been or might have been circumstances which were likely to create a hazard to human health through human consumption of food;

And whereas the Secretary of State was of the opinion, as mentioned in section 1(1)(b) of the said Act, that in consequence of the said circumstances, food which was, or might have been in the future derived from sheep in the areas described in Schedule 1 to the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) Order 1991(2), was, or might have been, or might have become, unsuitable for human consumption;

And whereas the Secretary of State is now of the opinion that food which is derived, or may in the future be derived from sheep in the area described in Part I of the Schedule to this Order is no longer unsuitable for human consumption in consequence of the said circumstances;

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 1(1) and (2) and section 24(1) and (3) of the said Act(3), and of all other powers enabling him in that behalf, hereby makes the following Order:-

Title and commencement

1. This Order may be cited as the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) (Partial Revocation) Order 1996 and shall come into force on 17th January 1996.

Partial Revocation

2.-(1) The Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) Order 1991 is hereby revoked with respect to that part of the designated area numbered 2 of Schedule 1 to that Order which is set out in Part I of the Schedule to this Order.

(2) In consequence of that revocation that Order shall be amended by substituting for paragraph 2 of Schedule 1 the paragraph set out in Part II of the Schedule to this Order.

SCHEDULE

PART IPART OF AN AREA NO LONGER DESIGNATED

The part of the designated area referred to in article 2(1) which lies within the following boundary:-

This part of a designated area includes any part of a road or body of water by reference to which its boundary is defined.

PART IITHAT PART OF THE AREA NUMBERED 2 IN SCHEDULE 1 TO THE FOOD PROTECTION (EMERGENCY PROHIBITIONS) (RADIOACTIVITY IN SHEEP) (WALES) ORDER 1991 REMAINING DESIGNATED

"2. An area comprising that part of the county of Gwynedd which lies within the following boundary:-

The area excludes any part of a road, footpath or body of water by reference to which its boundary is defined."

Explanatory Note

(This note is not part of the Order)

This Order further partially revokes the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) Order 1991 ("the principal Order") which contains emergency prohibitions restricting various activities in order to prevent human consumption of food which has been or which may have been rendered unsuitable for that purpose in consequence of the escape of radioactive substances from a nuclear reactor situated at Chernobyl in the Ukraine.

This partial revocation reduces a designated area in the county of Gwynedd subject to the restrictions set out in the principal Order.

Maps showing the areas which are designated by the principal Order and the area derestricted by this Order are available for inspection during normal office hours at the offices of the Welsh Office Agriculture Department at Penrallt, Caernarfon, Gwynedd LL55 1EP; Government Buildings, Spa Road East, Llandrindod Wells, Powys LD1 5HA and Cathays Park, Cardiff, South Glamorgan CF1 3NQ.
