REGISTRATION OF BIRTHS, DEATHS, MARRIAGES, ETC. ENGLAND AND WALES

The Registrar General, in exercise of the powers conferred on him by sections 9(5), 10A(1)(b)(i) and (c)(i), 14(1), 29(2) and 39(a) of the Births and Deaths Registration Act 1953(1), as extended by section 26(3) of the Welsh Language Act 1993(2) and of all other powers enabling him in that behalf, with the approval of the Chancellor of the Exchequer(3), hereby makes the following Regulations-
1. These Regulations may be cited as the Registration of Births and Deaths (Amendment No. 2) Regulations 1997 and shall come into force on 1st July 1997.
2.-(1) The Registration of Births and Deaths Regulations 1987(4) shall be amended in accordance with the following provisions of this regulation.
(2) In regulation 17 (re-registration of birth) in paragraph (3) for sub-paragraph (a) there shall be substituted the following sub-paragraph-
"(a)call upon the parent to make and sign a statement in form 2 in accordance with the authority of the Registrar General;".
(3) In regulation 20 (re-registration where parent attends)-
(a)paragraphs (1) and (2) shall be omitted; and
(b)in paragraph (3)-
(i)for the words "The registrar shall then in the presence of the parent -" there shall be substituted the words "Where the parent attends personally at the office of the relevant registrar for re-registration, the registrar shall -";
(ii)for sub-paragraph (a) there shall be substituted the following sub-paragraph-
"(a)ascertain from the parent the particulars to be registered concerning the birth and enter them in spaces 1 to 13 of form 1 in the presence of the parent and in accordance with the authority of the Registrar General;"; and
(iii)in sub-paragraph (b) the words from "enter in space 12" to "as the case may be, and" shall be omitted.
(4) In regulation 21 (making of declaration where parent does not attend) in paragraph (1)-
(a)the words "with the written consent of the Registrar General" shall be omitted; and
(b)at the end of the paragraph there shall be inserted the words ", provided that if the parent is not in England and Wales, he has obtained the written consent of the Registrar General".
(5) In regulation 55 (correction of minor clerical errors after completion)-
(a)in paragraph (2) after sub-paragraph (c) there shall be inserted the following sub-paragraph-
"(cc)omission of the words required to be added in space 15 of a birth entry by regulation 17(2)(c), 17(4)(c), 20(3)(c), or 22(d);"; and
(b)in paragraph (4) after the words "regulations 20, 22, 23 and 26A(5)" there shall be inserted the words "and is not one to which sub-paragraph (2)(cc) applies,".
(6) In Schedule 2-
(a)for form 2 there shall be substituted form 2 in Schedule 1 to these Regulations; and
(b)forms 5 and 6 shall be omitted(6).
3. In the Registration of Births and Deaths (Welsh Language) Regulations 1987(7) in Schedule 2-
(a)for form 2 there shall be substituted form 2 in Schedule 2 to these Regulations; and
(b)forms 5 and 6 shall be omitted(8).

These regulations amend the Registration of Births and Deaths Regulations 1987 and the Registration of Births and Deaths (Welsh Language) Regulations 1987. They make minor changes to the procedure for re-registration of a birth to add the name of the child's father or on legitimation of the child and extend the existing provision cor correction of minor clerical errors in re-registered birth entries
1953 c. 20. See section 41 (as amended by S.I. 1996/273) for definitions of "the Minister"and "prescribed". Section 9(5) was added by section 93(3) of the Children Act 1975; section 10A was substituted by section 25 of the Family Law Reform Act 1987 and amended by section 108(4) and paragraph 6 of Schedule 12 to the Children Act 1989; section 14(1) has been amended by section 1(2) of the Legitimation (Re-registration of Birth) Act 1957, section 108(1) and paragraph 13 of Schedule 3 to the Children Act 1975 and section 33(1) and paragraph 16(a) of Schedule 2 to the Family Law Reform Act 1987.
The approval of "the Minister" is required by section 39 of the Births and Deaths Registration Act 1953. The function of approving regulations was transferred to the Chancellor of the Exechequer by article 3(1) and paragraph 8(b) of Schedule 1 to the Transfer of Functions (Registration and Statistics) Order 1996 (S.I. 1996/273).
