The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by sections 210(2)(a) and 215(2) of the Housing Act 1996(1), and of all other powers enabling them in that behalf, hereby make the following Order:
1. This Order may be cited as the Homelessness (Suitability of Accommodation) (Amendment) Order 1997 and shall come into force on 1st September 1997.
2. In the Homelessness (Suitability of Accommodation) Order 1996(2), at the end add-

For the purposes of section 197(1) of the Housing Act 1996 (duty where other suitable accommodation available), accommodation shall not be regarded as suitable unless the local housing authority are satisfied that it will be available for occupation by the applicant for at least two years beginning with the date on which he secures it.".
