The Secretary of State, in exercise of the powers conferred on him by sections 49(7) and 77(4) of the Criminal Procedure and Investigations Act 1996(1), hereby makes the following Order:
1. This Order may be cited as the Criminal Procedure and Investigations Act 1996 (Appointed Day No. 6) Order 1997.
2. 1st October 1997 is hereby appointed for the purposes of section 49 of the Criminal Procedure and Investigations Act 1996.

This Order appoints 1st October 1997 for the purposes of section 49 of the Criminal Procedure and Investigations Act 1996 (either way offences: accused's intention as to plea).
Section 49 extends to England and Wales only and applies where a person appears or is brought before a magistrates' court on or after 1st October 1997, unless he has appeared or been brought before such a court in respect of the same offence on a previous occasion falling before that date (section 49(6)).
