The Secretary of State, in exercise of the powers conferred on him by section 46(4) of the Teaching and Higher Education Act 1998(1), and all other powers enabling him in that behalf, hereby makes the following Order:
1. This Order may be cited as the Teaching and Higher Education Act 1998 (Commencement No.1) Order 1998.
2. The provisions of section 44(1) of the Teaching and Higher Education Act 1998 shall come into force on 18th July 1998 for the purpose of bringing into force the provisions of paragraph 4 of Schedule 3 to that Act on that day.

This Order brings into force the provisions of section 44(1) of the Teaching and Higher Education Act 1998, solely for the purpose of bringing into force the provisions of paragraph 4 of Schedule 3 to that Act. This paragraph amends the provisions of section 133 of the Education (Scotland) Act 1980 to require Regulations made under section 73(f) of that Act with respect to loans to be made, in certain circumstances, by being laid in draft before, and approved by a resolution of, each House of Parliament.
