The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:
1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemptions) (Castle Morpeth Borough Council and West Somerset and Uttlesford District Councils) Order 1998 and shall come into force on 17th September 1998.
2.-(1) The management of sports and leisure facilities(2) by the council of the borough of Castle Morpeth shall not be treated as a defined activity so long as it is carried out in that borough during the period beginning with 1st January 1999 and ending on 31st December 1999.
(2) The management of sports and leisure facilities by the council of the district of West Somerset shall not be treated as a defined activity so long as it is carried out during the period beginning with 17th September 1998 and ending on 1st March 2000, in the Aquasplash Leisure Centre, Seaward Way, Minehead.
3. The provision of financial services(3) by the council of the district of Uttlesford shall not be treated as a defined activity so long as it is carried out in that borough during the period beginning with 1st April 1999 and ending on 31st March 2000.

Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled.
Article 2 of this Order exempts from the requirements of Part I the management of sports and leisure facilities by Castle Morpeth Borough Council, so long as it is carried out in that borough during the period beginning with 1st January 1999 and ending on 31st December 1999 (para. 1); and by West Somerset District Council, so long as it is carried out during the period beginning with 17th September 1998 and ending on 1st March 2000, in the premises named in article 2(2). Article 3 of this Order exempts the provision of financial services by Uttlesford District Council so long as it is carried out in that borough during the period beginning with 1st April 1999 and ending on 31st March 2000.
