The Secretary of State for Social Security, in exercise of powers conferred by sections 167(1)(c), 171(1) and 175(1) to (3) of the Social Security Contributions and Benefits Act 1992(1) and of all other powers enabling her in that behalf, hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Statutory Maternity Pay (Compensation of Employers) Amendment Regulations 1998 and shall come into force on 6th April 1998.

Amendment of the Statutory Maternity Pay (Compensation of Employers) and Miscellaneous Amendment Regulations 1994

2. In regulation 3 of the Statutory Maternity Pay (Compensation of Employers) and Miscellaneous Amendment Regulations 1994(2) (determination of the amount of additional payment to which a small employer shall be entitled)-

(a)for "6th April 1997" substitute "6th April 1998"; and

(b)for "6.5 per cent." substitute "7 per cent.".

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Statutory Maternity Pay (Compensation of Employers) and Miscellaneous Amendment Regulations 1994 ("the principal Regulations").

The principal Regulations enable an employer to recover payments of statutory maternity pay and, if he is a small employer, an additional amount in respect of such pay. These Regulations increase the additional amount from 6.5 per cent. to 7 per cent. of the payment of statutory maternity pay. The increase takes effect from 6th April 1998.

The proposals for these Regulations, which are made under section 167(1)(c) of the Social Security Contributions and Benefits Act 1992, are exempt from reference to the Social Security Advisory Committee by virtue of section 172(3) of, and paragraph 8 of Part I of Schedule 7 to, the Social Security Administration Act 1992 (c. 5).

These Regulations impose no costs on business.
