The Council of the City of York (Millennium Bridge) Scheme 1998 Confirmation Instrument 1999

Coming into force in accordance with article 1

The Secretary of State for the Environment, Transport and the Regions makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980(1) and now vested in him(2) and of all other powers enabling him in that behalf:

1. This Instrument may be cited as "the Council of the City of York (Millennium Bridge) Scheme 1998 Confirmation Instrument 1999" and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

2. The Council of the City of York (Millennium Bridge) Scheme 1998 ("the Scheme") is hereby confirmed without modifications.

3. The Scheme as confirmed is set out in the Schedule hereto (including the plans) and copies of the Scheme with its accompanying plans are deposited at the offices of the Department of the Environment, Transport and the Regions, Great Minster House, 76 Marsham Street, London SW1P 4DR, and at the offices of the Council of the City of York, The Guildhall, St. Helen's Square, York YO1 9QN.

THE SCHEDULEThe Council of the City of York (Millennium Bridge) Scheme 1998

The Council of the City of York (hereinafter referred to as -�the Council') make this Scheme in exercise of their powers under Section 106(3) of the Highways Act 1980 and of all other powers enabling them in that behalf:-

1. The Council are authorised to construct over the navigable waters of the River Ouse in the City of York the bridge specified in the Schedule to this Scheme as part of the highway which they are proposing to construct between Butcher Terrace and Love Lane in the said City.

2. This Scheme may be cited as the Council of the City of York (Millennium Bridge) Scheme 1998.

THE SCHEDULEPlans and Specifications of the Millennium Bridge

The location and general design of the Bridge are shown on the plans numbered MB 001/A and MB 002/A and marked "The Council of the City of York (Millennium Bridge) Scheme 1998", sealed with the Common Seal of the Council and deposited at the offices of the Council at the Guildhall, St. Helen's Square, York YO1 9QN, and at the offices of the Secretary of State for the Environment, Transport and the Regions at Wellbar House, Gallowgate, Newcastle-upon-Tyne NE1 4TD.

Points of Commencement and Termination

From a point on the north-west bank of the River Ouse 94.0 metres south-east of the junction of Butcher Terrace with Terry Street, the junction being marked -�Reference Point A' on the deposited plan numbered MB 001/A.

To a point on the south-east bank of the River Ouse 63.0 metres north-west of the junction of Love Lane with Maple Grove, the junction being marked -�Reference Point B' on the deposited plan numbered MB 001/A.

Spans

Spans over land on the north-west bank of the River Ouse of 11.0 metres, 13.0 metres, 13.0 metres, 13.0 metres and 11.0 metres and over land on the south-east bank of the River Ouse a single span of 9.0 metres.

A single span over the River Ouse of 80.0 metres.

Headway

Not less than 5.70 metres above the mean high water spring tide level (-�MHWS') of 4.85 metres AOD rising to 6.80 metres above MHWS of 4.85 metres AOD.

Waterway

A minimum clear navigable waterway of 12.20 metres.

Overall Dimensions

The Bridge will be 13.0 metres wide overall and will carry a 4.0 metres wide cycle track with a right of way on foot.
