The Cosmetic Products (Safety) (Amendment) Regulations 1999

Whereas the Secretary of State is a Minister designated(1) for the purposes of the European Communities Act 1972(2) in relation to measures for safety and consumer protection as regards cosmetic products and any provisions concerning the composition, labelling, marketing, classification or description of cosmetics products:

Now, therefore, the Secretary of State in exercise of the powers conferred on him by section 2 of that Act hereby makes the following Regulations:-�

1.-(1) These Regulations may be cited as the Cosmetic Products (Safety) (Amendment) Regulations 1999 and, except as provided by paragraph (2) below, shall come into force on the 30th June 1999.

(2) Regulations 2(b), (c), and f(ii) shall come into force-�

(a)on 1st July 1999 in relation to the supply of any cosmetic product by the manufacturer or importer into the United Kingdom, or in the case of a cosmetic product manufactured or imported into the United Kingdom on behalf of another person, by that other person, except where the cosmetic product is supplied by retail in which case they shall come into force on 30th June 2000

(b)in all other cases on 30th June 2000.

2. The Cosmetic Products (Safety) Regulations 1996(3) are amended as follows-�

(a)in regulation 2(1), in the definition of "the Directive", by deleting the word "and" before "Commission Directive 98/16/EC"(4) and by adding the words ", and Commission Directive 98/62/EC"(5) at the end of that definition;

(b)in Schedule 1-�

(i)by the insertion after entry number 136 of the following-�

"136A1-tert-Butyl-3,4,5-trimethyl-2,6-dinitrobenzene489A422";

(ii)by the insertion after entry number 488 of the following-�

"488AMoskene543A421";

(iii)by the insertion after entry number 489 of the following-�

"489AMusk tibetene136A422";

(iv)by the insertion after entry number 543 of the following-�

"543A1,1,3,3,5,-Pentamethyl-4,6-dinitroindane488A421";

(c)in Part I of Schedule 2 by the substitution for entry number 57 of the following-�

"57Strontium chloride hexahydrate(a) Toothpaste3.5 per cent calculated as strontium. When mixed with other permitted strontium compounds the total strontium content must not exceed 3.5 per cent.-Contains strontium chloride. Frequent use by children is not advisable.
(b) Shampoo and face care products2.1 per cent calculated as strontium. When mixed with other permitted strontium compounds the total strontium content must not exceed 2.1 per cent.--�";

(d)in Part I of Schedule 4, by adding the following entry after entry number 53-�

"54Benzalkonium chloride, bromide and saccharinateAll products0.1 per cent calculated as benzalkonium chlorideA-Avoid contact with the eyes";

(e)in Part II of Schedule 4-�

(i)by the deletion of entry number 16;

(ii)in entry number 21 by the substitution for "30.6.1998" of "30.6.1999";

(iii)by the substitution for entry number 29 of the following-�

"293-Iodoprop-2-ynyl butylcarbamate [Iodopropynyl butylcarbamate]Not to be used in oral hygiene and lip products0.05 per cent--30.06.1999";

(f)in Part I of Schedule 5-�

(i)by adding the following entries after entry number 12-�

"13Ethoxylated ethyl-4-aminobenzoate10 per cent-�-�
[PEG-25 PABA]
14Isopentyl 4-methoxycinnamate10 per cent-�-�
[Isoamyl p-methoxycinnamate]

(ii)by adding the following after new entry 15-�

"162-(2H-Benzotriazol-2-yl)-4-methyl-6-{2-methyl-3-[1,3,3,3-tetramethyl-1-(trimethylsilyloxy)-disiloxan-1-yl]propyl}phenol [Drometrizole trisiloxane]15 per cent-�-�

(iii)by adding the following after new entry 17-�

(g)in Part II of Schedule 5-�

(i)by deleting entry numbers 2, 6, 12, 25, 26 and 32 and substituting the words "ENTRY DELETED"; and

(ii)by the substitution for "30.6.1998" in entry numbers 5, 17 and 29 of "30.6.1999".

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Cosmetic Products (Safety) Regulations 1996 (S.I. 1996/2925) ("the principal Regulations").

The Regulations implement Commission Directive 98/62/EC (OJ No. L253, 15.9.98, p. 20) to prohibit the supply of cosmetics products containing moskene and musk tibetene by adding these chemicals to the list of prohibited substances found at Schedule 1 of the principal Regulations. The Regulations make other technical amendments to Schedules 2, 4 and 5 of the principal Regulations (regulations 2(c) to (g)).

The Regulations come into force on 30th June 1999 except in the circumstances specified in Regulation 1(2).
