In exercise of the powers conferred on the Secretary of State by sections 1(5) and (7) and 42(6) and (7) of, and paragraph 3 of Schedule 1 to, the Teaching and Higher Education Act 1998(1), the Secretary of State for Education and Employment hereby make the following Regulations:
1. These Regulations may be cited as the General Teaching Council for England (Constitution) (Amendment) Regulations 1999 and shall come into force on 11th August 1999.
2. Regulation 12 of the General Teaching Council for England (Constitution) Regulations 1999(2) shall be amended by-�
(a)the substitution of the following for paragraph (1)-�
"(1) Before the Council have been established the Secretary of State may appoint a chairman for such term of office as he thinks fit,"; and
(b)the insertion after paragraph (1) of the following-�
"(1A) After the Council have been established, they shall elect a chairman from amongst their number." .

These Regulations amend the General Teaching Council for England (Constitution) Regulations 1999 to enable the Secretary of State to appoint the first chairman of the Council before their establishment. After the Council's establishment, subsequent chairman will be elected by Council members.
