The Secretary of State for Health, in exercise of powers conferred by sections 33(6) and 38(1)(a) of the Health Act 1999(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:-�

Citation and commencement

1. These Regulations may be cited as the Health Service Medicines (Consent to Voluntary Scheme) Regulations 1999 and shall come into force on 1st September 1999.

Manner of consent

2. For the purposes of section 33(2)(a) of the Health Act 1999, a manufacturer or supplier who wishes to consent to a voluntary scheme being treated as applying to him shall give his consent in the manner set out in Schedule 1 to these Regulations.

Manner of withdrawal of consent

3. A manufacturer or supplier who wishes to withdraw a consent given in accordance with regulation 2 of these Regulations shall withdraw his consent in the manner set out in Schedule 2 to these Regulations.

Explanatory Note

(This note is not part of the Regulations)

These Regulations set out the manner in which a manufacturer or supplier of health service medicines is required to consent (or withdraw consent) to a voluntary scheme being treated as applying to it. The voluntary schemes concerned are schemes for the control of profits and prices of manufacturers and suppliers of health service medicines made by the Secretary of State and the industry body. While there is in existence a voluntary scheme which a manufacturer or supplier has consented should apply to it, the Secretary of State is unable to exercise certain other statutory powers of control in relation to that company.
