HIGHWAYS, ENGLAND AND WALES

The Fishguard to Bangor Trunk Road (A487) (Llanwnda to South of Llanllyfni Improvement) Order 1999

The Secretary of State for Wales makes this Order in exercise of powers conferred by sections 10, 12 and 41 of the Highways Act 1980(1) and of all other enabling powers:-�

1. The new highway which the Secretary of State proposes to construct along the route described in Schedule 1 to this Order shall become a trunk road as from the date when this Order comes into force.

2. The centre line of the new trunk road is indicated by a heavy black line on the deposited plan.

3. The Secretary of State directs as respects any part of a highway which crosses the route of the new trunk road that:-�

(a)where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority, and

(b)where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,

until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for the purposes of through traffic.

4. The lengths of the trunk road described in Schedule 2 to this Order, and numbered 1-�4 therein, and shown by broad striped hatching on the deposited plan, shall cease to be trunk road and numbers 1 and 3 shall be classified as classified roads and numbers 2 and 4 will become unclassified roads as from the date on which the Secretary of State notifies Gwynedd Council that the new trunk road is open for through traffic.

5. In this Order-�

All measurements of distance are measured along the route of the relevant highway;

i."classified road" as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;

ii."the deposited plan" means the site plans numbered 1 to 3 as contained in the plan folder marked "The Fishguard to Bangor Trunk Road (A487) (Llanwnda to South of Llanllyfni Improvement) Order 1999" signed by authority of the Secretary of State and deposited at the Welsh Office Repository, Curran Embankment, Cardiff;

iii."the new trunk road" means the highway mentioned in Article 1 of this Order;

iv."the trunk road" means the Fishguard to Bangor Trunk Road (A487).

6. This Order shall come into force on 18th February 1999 and may be cited as the Fishguard to Bangor Trunk Road (A487) (Llanwnda to South of Llanllyfni Improvement) Order 1999.

SCHEDULE 1ROUTE OF THE NEW TRUNK ROAD

The route of the new trunk road is a route of about 8.6 kilometres in length, starting at the southerly end of the junction of the A487 Trunk Road with the A499 Llanwnda to Abersoch County Road (marked point A on the deposited plan at site plan No. 1) and extending in a south westerly direction comprising the A499 Llanwnda to Abersoch County Road for about 0.6 kilometres to a point 0.1 kilometres north of the property known as the -�Goat Hotel', (marked point B on the deposited plan at site plan No. 1) and then extending in a southerly direction for about 8.0 kilometres to a point on the A487 Trunk Road opposite the property known as -�Graianfryn' (marked point E on the deposited plan at site plan No. 3).

The lengths of the trunk road ceasing to be trunk road are the following:-�

That length starting at the junction of the trunk road with the A499 Llanwnda to Abersoch County Road (marked point AA on the deposited plan at site plan No. 1) and extending in a southerly direction for 2.31 kilometres to the junction of the trunk road with the road known as Lôn Cefn Glyn (Class 3 road) (marked point BB on the deposited plan at site plan No. 1).

That length starting at the junction of the trunk road with the road known as Lôn Cefn Glyn (Class 3 road) (marked point BB on the deposited plan at site plan No. 1), and extending in a southerly direction for 0.49 kilometres to the junction of the trunk road and the access to the property known as -�Grugan-ddu' (marked point CC on the deposited plan at site plan No. 1).

Unclassified

3. That length starting at a point 0.355 kilometres south of the access to the property known as -�Grafog' (marked point DD on the deposited plan at site plan No. 2) and extending in a southerly direction for 4.20 kilometres to the junction of the trunk road with Ffordd Nasareth (unclassified road) opposite the property known as -�Fron-Deg' (marked FF on the deposited plan at site plan No. 3).

4. That length starting at the junction of the trunk road with Ffordd Nasareth (unclassified road) opposite the property known as -�Fron-Deg' (marked point FF on the deposited plan at site plan No. 3) and extending in a southerly direction for 0.750 kilometres to a point 0.35 kilometres north of the junction of the trunk road with Ffordd y Parc (unclassified road) adjacent to the property known as -�Graianfryn' (marked point GG on the deposited plan at site plan No. 3).
